CHAPTER 29 -MUNICIPAL ELECTIONS
Section 29-103. ABSENTEE BALLOT PRECINCT. An Absentee Ballot Precinct is hereby
created in the City of Brooklyn Center. The precinct shall consist of a board of not less than three
persons appointed by the city clerk. The duties of the board shall be to:
1. Receive all absentee ballots for a primary or general election held within the municipality.
2. Check the registration of each absentee ballot against the permanent voter registration file.
3. Prepare a list of absentee ballots for submission to each precinct within the municipality prior
to the close of the election date for the respective precinct officials to check against the voter
registration files to ascertain if any absentee ballot voter voted by person.
4. Reject any absentee ballots of persons who had voted at a precinct, making a notation on the
envelope of the absentee ballot as to the reason for rejection.
5. Count the absentee ballots by opening them and tabulating the vote of each absentee ballot
voter in a manner which will indicate each vote of the absentee voter and will indicate that
the vote was received by absentee ballot.
6. Report the respective absentee vote results to each precinct with such results to be tabulated
with that precinct.
Section 29-201. REGISTRATION SYSTEM ADOPTED. The system for the permanent
registration of voters provided for by Minnesota Statutes, Chapter 201, is hereby adopted for the City
of Brooklyn Center.
Section 29-202. VOTERS MUST BE REGISTERED. No person shall be permitted to vote
at any election held in the City of Brooklyn Center unless he shall have registered as provided in said
Act.
Section 29-301. OFFICE OF CONSTABLE ABOLISHED. Pursuant to the provisions of
Minnesota Statute 212.34, and the City of Brooklyn Center having one or more regularly employed
City police officers, the office of constable is hereby abolished effective at the end of the term of the
incumbents or earlier upon any vacancy occurring therein more than thirty (30) days after publication
hereof.

Section 29-401.FILING FOR MUNICIPAL OFFICE. At least two (2) weeks before the first
day to file affidavits of candidacy, the city clerk shall cause to be published in the official newspaper
a notice of filing for municipal office. The notice of filing shall designate the officer to be elected,
the period during which affidavits of candidacy may be filed, and the time and place for filing such
affidavits. The city clerk shall post a similar notice at least ten (10) days before the first day to file
affidavits of candidacy. Not more than 84 days nor less than 70 days before the municipal primary
election any person who is eligible and desires to become a candidate for a municipal office shall file
an affidavit of candidacy with the city clerk. The affidavit shall be substantially the same form as
required of candidates for state offices. Upon payment of a filing fee of twenty-five dollars ($25) by
a potential candidate or filing by the petition of fifty (50) registered voters on behalf of the candidate,
the clerk shall certify the eligibility of the candidate and place the name of the candidate upon the
election ballot without partisan designation.
Section 29-402. MUNICIPAL PRIMARY ELECTION. In the event more than twice the
number of persons to be elected to a municipal office file for the nomination thereof, there shall be a
municipal primary election which shall be held on the second Tuesday in August. The number of
candidates equal to twice the number of persons to be elected to the municipal office, who receive
the highest number of votes, shall be the nominees for the office named. The city clerk shall give at
least two (2) weeks previous notice of the time and place of holding such municipal primary election
and of the officers to be elected by posting in at least one (1) public place in each voting precinct and
by one (1) publication in the official newspaper, but failure to give such notice shall not invalidate
the election. At least one (1) week before the election the city clerk shall publish a sample municipal
primary ballot in the official newspaper and shall post a sample ballot in office for
public inspection.
Section 29-403. MUNICIPAL GENERAL ELECTION. The municipal general election
shall be held on the first Tuesday after the first Monday in November. The city clerk shall give at
least two (2) weeks previous notice of the time and place of holding such municipal general election
and of the officers to be elected by posting in at least one (1) public place in each voting precinct and
by one (1) publication in the official newspaper, but failure to give such notice shall not invalidate
the election. At least one (1) week before any municipal election, the city clerk shall publish a
sample ballot in the official newspaper, and shall post a sample ballot in office for
public inspection.
Section 29-404. POLLING TIMES. The polls at all municipal elections shall be open from
7:00 a.m. to 8:00 p.m. on the respective election day.
Section 29-405. EXTENSION OF TERMS OF OFFICE TO CONFORM WITH CHARTER
AMENDMENTS. The terms of office of the mayor and members of the city council existing on
December 4, 1986, the effective date of charter amendments, are hereby extended to conform to such
charter amendments.

1.The term of office of mayor is extended through and including December 31, 1990.
2. The term of council member occupied by Council Member Hawes is extended through and
including December 31, 1988.
3. The term of council member occupied by Council Member Lhotka is extended through and
including December 31, 1990.
4. The term of council member occupied by Council Member Scott is extended through and
including December 31, 1990.
5. The term of council member occupied by Council Member Theis is extended through and
including December 31, 1988.
Section 29-406. EXTENDED TERMS DEEMED TRANSITORY. Upon expiration of the
extended terms described in this Ordinance, terms of office of the mayor and council members shall
conform in all respects to the City Charter.
