Home My WebLink About2021-107 CCR Member BLitler introduced the following resolution and moved its adoption: RESOLU"TION NO. 2021-107 A RESOLUTION AUTI-IORIZING A CIVIL ENFORCEMENT ACTION RFGARDING SIGN ORDINANCE VIOLATIONS AND NUISANCE CONDI"I'IONS EXISTING AT 3006 65`l��I AVENUE NORTI-I WHf:REAS, the City of Brooklyn Center ("City") has received complaints regarding conditions existing on the property located at 3006 65th Avenue North, legally described as Lot 2, I31ock 1, Garden City 6th Addition, Hennepin County, Minnesota (the "Property"); and W1�EREAS, according to public records, the Property is owned by Tommy McCall and Shivon McCall (the "Owners") and the City understands the Property is occupied by one or both of the Owners; and WHEREAS, the City received complaints regarding signs painted on the home on the Property and the general nuisance condition of the Property; and WHEREAS, the City inspected the Property and staff observed a varicty of graffiti painted directly on the exterior wall of the home on the Property, including a large painting of�a vulgar word on the outside of the home; and WHEREAS, section 34-130(12) of the Brooklyn Center City Code (the "City Code") �� provides that "signs painted directly on building walls" are prohibited and the signs exceed the �I total area of signs allowed on residential properties; and �I WHEREAS, section 34-210 of the City Code provides that it is unlawful for any person to � maintain any sign or sign structure or cause or permit the same to be done in violation of any oi� � the provisions of Chapter 34 (the "Sign Ordinance"); and '�� WHEREAS, section 19-101 of the City Code deems it a public nuisance to maintain or permit a condition which unreasonably annoys, injures or endangers the safety, health, morals, comfort, or repose of any number of inembers of the public; and WHEREAS, the signs distract those driving on the City's street and unreasonably annoys the morals, comfort, and repose of those living and raising families in the neighborhood; and WHEREAS, pursuant to section 19-105 of the City Code, the City Council may order the abatement of certain violations by the City on any premises and the City has the authority to institute a legal action to correct violations of the City Code; and WHEREAS, by letter dated and mailed on July 22, 2021, attached as Exhibit A, the City notified the Owners of the violations of certain code provisions and conditions addressed in this resolution, as well as action and deadlines required to correct the conditions; and A-1 l3 R2 9 1-4-7426 5 2.v3 RESOLL7TION NO. 2021-107 ', nditi n of the Pro ert with the Owners II WHEKhAS, the C,ity also offered to discuss the co o p y , issued administrative citations to the Owners on August 9, 2021 and August 16, 2021, and communicated to the Owners that if they fail to bring the Property into compliance the City would �� institute additional enforcement actions; and ' WHEREAS,the deadline provided in the City's letter has passed without corrective actions by the Owners and the adillinistrative citations have not t•esulted in the Owners correcting the �� violations; and I WHEREAS, based on the information presentcd, the City Council determines thc � conditions of the Property violate the Sign Ordinance and constitute a public nuisance that need to I be abated. NOW, THEREFORE, BE IT RESOLVI:D by the City Council of the City of Brooklyn Center, Minnesota, that: l. The City Council adopts, as factual findings, all of the above-listed recitals, and tinds , violations of the City Code provisions identified in this Resolution. 2. The condition of the Property violates the Sign Ordinancc and constitutes a public � nuisance in light of these violations. �� 3. The City Council directs City staff and the City Attorney to undertake a civil enforcement action in district court to seek an order requiring the Owners to abate the City Code � violations, to allow the City to take action to correct the violations if the Owners fail to do � so as directed in the order, and to pursue such other actions as may be appropriate under law to correct the violations.
