RESOLUTION NO. 2021-115
RESOLUTION VACATING CERTAIN EASEMENTS WITHIN LOT 1, BLOCK 1,
EVANGELICAL LUTHERAN CHURCH OF THE MASTER 2ND ADDITION,
HENNEPIN COUNTY, MINNESOTA
WHEREAS, the Planning Commission has recommended approval for the plat for
69�' AVENUE NORTH ADDITION based on certain conditions as set forth in the City Council
Resolution No.No. 2021-84 and Planning Commission Resolution No. 2021-02; and
WHEREAS, certain existing easements on existing properties are either no longer
needed, or are being replaced by new easements pertaining to the properties contained within the
proposed plat for 69th AVENUE NORTH ADDITION; and
WHEREAS, the easements proposed to be vacated are identified as follows and
are hereafter referred to as "the Easements":
That part of Lot 1, Block 1, EVANGELICAL LUTHERAN CHURCH OF THE
MASTER 2ND ADDITION, Hennepin County, Minnesota, described as follows:
Commencing at the southeast corner of said Lot 1;thence northerly along the
easterly line of said Lot 1, a distance of 142.99 feet,more or less,to a corner of said
Lot 1; thence westerly along the northerly line of said Lot 1, a distance of 140.00
feet,more or less,to a corner of said Lot 1 and also the point of beginning of the
parcel to be described;thence continuing along the last described line to a point that
is distance 5.00 feet westerly of the easterly line of said Lot 1;thence northerly
parallel to the easterly line of said Lot 1, a distance of 105.20 feet,more or less,to
the intersection with a line drawn parallel with and 10.00 feet southerly of the
northerly line of said Lot 1; thence easterly parallel with the northerly line of said
Lot 1, a distance of 5.00 feet to said easterly line of said Lot 1;thence southerly,
along said easterly line of said Lot 1,to the point of beginning.; and
WHEREAS, after due notice and public hearing, the City Council has determined
that the Easements will be no longer needed, once the plat of 69th AVENUE NORTH
ADDITION is recorded, and it is in the public interest to vacate the Easements;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center, Minnesota, that:
1. The City Council hereby approves the vacation of the Easements described
above and depicted in the attached Exhibit.
2. The City Clerk is directed to prepare a Notice of Completion of Vacation
RESOLUTION NO. 2021-115
Proceedings and to record it with the Hennepin County Recorder or Hennepin
County Registrar of Titles, as appropriate; provided,that this resolution will only
take effect upon the release and filing of the final plat of 69�"AVENUE NORTH
ADDITION, execution and filing of associated and separate rededicated
easements, and upon execution and filing the subdivision agreement for said
associated development.

The motion for the adoption of the foregoing resolution was duly seconded by member
Graves
and upon vote being taken thereon, the following voted in favor thereof:
Butler, Elliott, Graves, Lawrence-Anderson, Ryan
and the following voted against the same: None
whereupon said resolution was declared duly passed and adopted.
