RESOLUTION APPROVING SUMMARY PUBLICATION OF INTERIM
ORDINANCE NO. 2022-02 AUTHORIZING A STUDY AND IMPOSING A
MORATORIUM ON THE ESTABLISHMENT OF NEW USES OR THE EXPANSION
OF EXISTING USES RELATED TO THE SALE OF THC PRODUCTS
WHEREAS,the City Council of the City of Brooklyn Center acted at its August 22, 2022
meeting to adopt Ordinance No. 2022-02, "An Interim Ordinance Authorizing a Study and
Imposing a Moratorium on the Establishment of New Uses or the Expansion of Existing Uses
related to the Sale of THC Products" ("Ordinance"); and
WHEREAS, Minnesota Statutes, section 412.191, subdivision 4 allows publication of
adopted ordinances by title and summary in the case of lengthy ordinances or those containing
maps or charts; and
WHEREAS, the City Council determines publishing the entire text of the Ordinance is
not in the best interests of the City as the Ordinance is readily available to the public on the
City's website and by contacting City Hall; and
WHEREAS, the City Council determines the following summary clearly informs the
public of the intent of Ordinance and where to obtain a copy of the full text.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Brooklyn
Center hereby approves publication of the following summary language as publication of the
Ordinance:

MORATORIUM ON THE ESTABLISHMENT OF NEW USES OR THE EXPANSION OF
EXISTING USES RELATED TO THE SALE OF THC PRODUCTS
The Brooklyn Center City Council adopted the above-referenced interim ordinance establishing
a moratorium on the sale of cannabinoid products, as that term is now defined in state law. The
2022 Legislature adopted an amendment to Minnesota Statutes, section 151.72 which permits the
retail sale of edible cannabinoid products as of July 1, 2022. The act authorizes the Minnesota
Board of Pharmacy to enforce the law but provides no guidance regarding regulation. Brooklyn
Center, like most cities, is unprepared to regulate the sale of these products. The interim
ordinance declares a moratorium on such sales and authorizes a study to determine if and how
the City wishes to regulate sales. Medical cannabis and hemp products which could be sold
legally before July 1, 2022, are exempt from the moratorium. The ordinance is in effect 30 days
from this publication. The full text of the ordinance is available on the City's website and can be
obtained by contacting City Hall.

The motion for the adoption of the foregoing resolution was duly seconded by member
Lawrence-Anderson
and upon vote being taken thereon, the following voted in favor thereof:
Butler, Elliott, Graves, Lawrence-Anderson, Ryan
and the following voted against the same: None
whereupon said resolution was declared duly passed and adopted.
