RESOLUTION NO. 98-180
RESOLUTION AMENDING THE POLICY FOR PUBLIC UTILITY ACCOUNT
COLLECTIONS REGARDING UNPAID ACCOUNTS OF PRIOR nVINEB S
WHEREAS, the Minnesota State Law defines municipal utilities to be services to the
property; and
WHEREAS, the City of Brooklyn Center's policy has been to rely on this law to apply
the unpaid bill of a former owner to the account of a new owner; and
WHEREAS, this works a hardship on new homeowners who have taken all reasonable
and prudent steps normally followed at the time of a sale closing to discover liabilities on a property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn
Center, Minnesota, that the Policy for Public Utility Account Collections is amended as follows:
1. For residential properties undergoing sale to new owners, where a delinquent utility
bill exists which had not been pended to the assessment rolls prior to the date of closing
on the sale to the new owner, it shall be the policy to not apply an unpaid balance of
the old owner to the account of the new owner.
2. This policy change shall be effective as of January 1, 1998 and the Finance Department
shall credit all accounts it is aware of since that date in which the unpaid balance of the
old owner was applied to the account of the new owner.

The motion for the adoption of the foregoing resolution was duly seconded by member Debra
Hilstrom , and upon vote being taken thereon, the following voted in favor thereof:
Myrna Kragness, Kathleen Carmody, Debra Hilstrom, Kay Lasman, and Robert Peppe;
and the following voted against the same: none;
whereupon said resolution was declared duly passed and adopted.
