Minutes of the proceeding of the Dark Board
of the Village of Brooklyn Center in the
County of Hennepin and State of Minnesota,
January 13, 1959

RESOLUTION AUTHORIZING TRANSFER CF PARK LAND
WHEREAS, the tract of land hereinafter described has essentially
no market value, and
WHEREAS, said tract of land is not suitable for construction of
buildings due to soil structure, and
WHEREAS, it is not economically 'feasible to improve, develop, and
maintain said tract of land as a public park,F
NOW, THEREFORE, BE IT RESOLVED, by the Park Board of the Village of
Brooklyn Center as follows
1, It is hereby dietermined to be in the public interest to transfer
to Independent School District 279, Osseo, Minnesota, the following
described tract of land:
That part of Brooklane Addition known as Public Playground
lying South of 65th Avenue North, West of Drew Avenue forth,
and North of the South line of SW4 of NET', Section,34, 7119o
R 21, Hennepin County, Minnesota.

2. The officers of the Park Board are hereby authorized and directed
to execute and deliver a deed running to Independent School HistA ct
279, Osseo, Minnesota for the aforementioned tract of land.

The foregoing resolution was duly seconded by Dallas Lawrence and upon
vote being taken thereon the following voted in favor thereof: Dallas
Lawrence and Francis Irvin; and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted,
Paul Bullen arrived at this point and resumed his duties as chairman.
The Board reviewed the report of the Commissioners in the Condemnation
proceedings to acquire property between Bryant and Camden and 53rd and 55th
Avenue North,
Member Dallas Lawrence introduced the following resolution and moved
its adoptions
The Park Board met in special session and was called to order by
Dallas Lawrence, Secretary, at 9:00 P.M.
Roll Call: Dallas Lawrence and Francis Irvin were present; Paul
Bullen was absent.
Motion made by Francis Irvin seconded by Dallas Lawrence to accept
the quotation of $p257*50 submitted by Post Publishing Company for the
printing and distribution of the Park Board Progress Report, Motion carried,
Member Francis Irvin introduced the following resolution and moved its
adoption:

WHEREAS, it appears that certain awards made by the Commissioners in
the condemnation proceedings relating to property lying between Bryant
and Camden and 53rd and 55th Avenues North, and at 50th and Abbott
Avenues North were in excess of the fair market value ant it appearing
to be in the public interest that such awards be appealed to the District
Court of Hennepin County,
NOW THEREFORE, BE IT RESOLVED by the Park Board of the Village of Brook
lyn Center as f ollowss
1. That the village attorney is herewith instructed to prepare and
carry out an appeal in the condemnation proceedings insofar as they
relate to the awards for Tracts 1 and 2 owned by Nels Fagerhaug and
Gurine Fagerhaug, Tract 26 owned by Theodore Ft Huttle and Agnes V,
Huttle, and Tract 30 owned by J. Raymond Carlson and Lucille R. Carlson,
The foregoing resolution was duly seconded by Paul Bullen and upon vote
being taken thereon the following voted in favor thereof: Paul Bullen and
Dallas Lawrence; Francis Irvin abstained; and the following voted against the
same: None; whereupon said resolution was declared duly passed and adapted,
The meeting was adjourned at 10:30 P,M.
