HomeMy WebLinkAbout1997-030 CCR1 1 adoption: Member Kathleen Carmody introduced the following resolution and moved its RESOLUTION NO. 97 30 RESOLUTION APPROVING THE AMENDMENT AND RESTATEMENT OF THE CITY OF BROOKLYN CENTER HEALTH CARE AND DEPENDENT DAY CARE EXPENSE REIMBURSEMENT PLAN WHEREAS, the City of Brooklyn Center previously adopted the City of Brooklyn Center Health Care and Dependent Day Care Expense Reimbursement Plan which includes flexible benefit provisions; and WHEREAS, the City of Brooklyn Center desires to amend and restate such Plan as presented to the City Council. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Brooklyn Center that the City of Brooklyn Center Health Care and Dependent Day Care Expense Reimbursement Plan be and the same is amended, restated, and adopted in the form presented to the City Council, effective as of March 1, 1997. BE IT FURTHER RESOLVED, that any proper members of the City Council are hereby authorized to make such contributions from the funds of the Company as are necessary to carry out the provisions of said plan at any time. BE IT FURTHER RESOLVED, that in the event any conflict arises between the provisions of said Plan and the Employee Retirement Income Security Act of 1974 ERISA) or any other applicable law or regulation (as such law or regulation may be interpreted or amended), the City shall resolve such conflict in a manner which complies with ERISA or such law or regulation.
