HomeMy WebLinkAbout1995-161 CCRMember Kathleen Carmody introduced the following resolution and moved its adoption: RESOLUTION NO. 95 -161 RESOLUTION DECLARING A PUBLIC NUISANCE AND ORDERING THE REMOVAL OF DISEASED TREES (ORDER NO. DST 07/24/95 WHEREAS, a Notice to Abate Nuisance and Diseased Tree Removal Agreement has been issued to the owners of certain properties in the City of Brooklyn Center giving the owners twenty (20) days to remove diseased trees on the owners' property; and WHEREAS, the City can expedite the removal of these diseased trees by declaring them a public nuisance: NOW, THEREFOR, BE IT RESOLVED BY THE CITY COUNCIL of the City of Brooklyn Center, Minnesota that: ATTEST: 1. The diseased trees at the following addresses are hereby declared to be a public nuisance: PROPERTY OWNER TOU HOU VVE CHUE LEE JOSEPH CHERYL TORRES RICHARD CYNTHIA RANWICK CITY OF B.C. MARTHA WEBER CITY OF B.C. MARTIN ELIZABETH HIGGINS RICHARD CYNTHIA ANGRIST LLOYD PHYLLIS DEVEL PROPERTY ADDRESS 3625 72ND AVE N 3812 72ND AVE N 6806 QUAIL AVE N WILLOW LANE PARK 5040 BROOKLYN BLVD HAPPY HOLLOW PARK 6901 REGENT AVE N 6906 SCOTT AVE N 1606 72ND AVE N TREE NUMBER 74 75 76 77 78 79 80 81 82 2. After twenty (20) days from the date of the notice, the property owner(s) will receive a second written notice providing five (5) business days in which to contest the determination of the City Council by requesting, in writing, a hearing. Said request shall be filed with the City Clerk. 3. After five (5) days, if the property owner'fails to request a hearing, the tree(s) shall be removed by the City. All removal costs, including legal, financing, and administrative charges, shall be specially assessed against the property. July 24. 1995 Date Deputy City Clerk ..--/-11,444444--- Mavcik 1 1 RESOLUTION NO. 95 -161 The motion for the adoption of the foregoing resolution was duly seconded by member Debra Hilstrom and upon vote being taken thereon, the following voted in favor thereof: Myrna Kragness, Kristen Mann, Debra Hilstrom, and Kathleen Carmody; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
