RESOLUTION NO. 95 -93
RESOLUTION CERTIFYING SPECIAL ASSESSMENT FOR IMPROVEMENT
PROJECT NOS. 1995 -07 AND 08, WOODBINE NEIGHBORHOOD STREET
AND STORM DRAINAGE IMPROVEMENTS, TO THE HENNEPIN
COUNTY TAX ROLLS
WHEREAS, pursuant to proper notice duly given as required by law, the City
Council has met and heard and passed upon all objections to the proposed Special Assessment
Levy Nos. 13372 and 13373 for the following improvements:
WOODBINE NEIGHBORHOOD STREET IMPROVEMENT
IMPROVEMENT PROJECT NO. 1995 -07 (Levy No. 13372)
WOODBINE NEIGHBORHOOD STORM DRAINAGE IMPROVEMENT
IMPROVEMENT PROJECT NO. 1995 -08 (Levy No. 13373)
WHEREAS, Special Assessment Levy Nos. 13372 and 13373 were on March 27,
1995 approved by the City Council; and
WHEREAS, an assessment roll, a copy of which is attached hereto and part
hereof by reference, has been prepared by the City Clerk, tabulating those properties where a
street improvement account is to be assessed with the amount, including interest and service
charges, to be assessed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL of the City
of Brooklyn Center, Minnesota, that:
1. Such proposed assessments, Special Assessment Levy Nos. 13372 and
13373 made a part hereof, are hereby accepted and shall constitute the
special assessments against the lands named therein, and each tract of land
therein included is hereby found to be benefited by the improvements in
the amount of the assessments levied against it.
2. Such assessments shall be payable in equal annual installments extending
over a period of (10) years as indicated on the assessment roll. The first
of the installments shall be payable with ad valorem taxes in 1996, and
shall bear interest at the rate of seven (7) percent per annum for a period
of fifteen months from October 1, 1995 through December 31, 1996.

3. The owner of any property so assessed may at any time prior to the
certificate of the assessment to the County Auditor in accordance with
administrative procedures pay part or the whole of the assessment, with
interest accrued to the date of payment, to the City Treasurer, except that
no interest shall be charged on that portion of the assessment that is paid
prior to October 1, 1995; and he or she may, at any time thereafter, pay
to the City Treasurer the entire amount of the assessment remaining
unpaid, with interest accrued to December 31 of the year in which such
payment is made. Such payment must be made before November 15, or
interest shall be charged through December 31 of the succeeding year.
4. The City Clerk shall forthwith transmit a certified duplicate of this
assessment to the County Auditor to be extended on the proper tax lists
of the county, and such assessments shall be collected and paid over in the
same manner as other municipal taxes.

The motion for the adoption of the foregoing resolution was duly seconded by member
Kathleen Carmody and upon vote being taken thereon, the following voted in
favor thereof: Myrna Kragness, Kristen Mann, Debra Hilstrom, and Kathleen Carmody;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
