RESOLUTION NO. 95 -94
introduced the following resolution and
RESOLUTION ORDERING IMPROVEMENT, APPROVING PLANS AND
SPECIFICATIONS, AND AUTHORIZING ADVERTISEMENT FOR BIDS,
IMPROVEMENT PROJECT NOS. 1994 -05 AND 06, HUMBOLDT AVENUE, 69TH
AVENUE TO 73RD AVENUE STREET AND UTILITY IMPROVEMENTS
WHEREAS, the Brooklyn Center City Council on September 20, 1993 authorized
consideration of street and utility improvements on Humboldt Avenue North, from 69th Avenue
to 73rd Avenue; and
WHEREAS, the Council has previously received and accepted a feasibility report
for said proposed improvements, as prepared by the City engineer; and
WHEREAS, the City's consulting engineer has prepared construction plans and
specifications for the proposed improvements; and
WHEREAS, Resolution No. 95 -64, adopted on the 27th day of February, 1995,
set a date for a public hearing regarding proposed improvements for Humboldt Avenue, 69th
Avenue to 73rd Avenue; and
WHEREAS, ten days published notice of the hearing was given and the hearing
thereon was held on the 27th day of March, 1995, at which time all persons desiring to be heard
were given an opportunity to be heard thereon; and
WHEREAS, the Council has considered all comments, testimony, evidence, and
reports offered at or prior to the March 27, 1995 hearing.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center, Minnesota that:
1. Improvement Project Nos. 1994 -05 and 06, Humboldt Avenue, 69th Avenue to
73rd Avenue, Street and Utility Improvements, Contract 1995 -B are hereby
ordered.
2. The plans and specifications prepared by the City's consulting engineer for said
improvements are hereby approved.

3. The Deputy City Clerk shall prepare and cause to be inserted in the official
newspaper and in the Construction Bulletin an advertisement for bids for the
making of such improvement in accordance with the approved plans and
specifications. The advertisement shall be published in accordance with
Minnesota Statutes, shall specify the work to be done and shall state the time and
location at which bids will be opened by the Deputy City Clerk and the City
Manager or their designees. Any bidder whose responsibility is questioned
during consideration of the bid will be given an opportunity to address the
Council on the issue of responsibility. No bids will be considered unless sealed
and filed with the Deputy City Clerk and accompanied by a cash deposit,
cashier's check, bid bond, or certified check payable to the City Clerk for 5
percent of the amount of such bid.

The motion for the adoption of the foregoing resolution was duly seconded by member
Kristen Mann and upon vote being taken thereon, the following voted in
favor thereof: Myrna Kragness, Kristen Mann, Debra Hilstrom, and Kathleen Carmody;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
