HomeMy WebLinkAbout1994-124 CCR1 Member Barb Kalligher introduced the following resolution and moved its adoption: WHEREAS, Minnesota Statues, Chapter 270.41, Subdivision 5 generally prohibits an Assessor or any assessing employee whose duties include valuing or classifying property for property tax purposes from making appraisals or analyses, accepting an appraisal assignment, or preparing an appraisal report, as defined in Minnesota Statutes 82B, within the assessment jurisdiction where the individual is employed; and WHEREAS, the prohibitions of this statute could be interpreted to include appraisals prepared on behalf of and at the request of the governmental unit that has employed the Assessor or other employee; and WHEREAS, the 1994 Legislature amended Minnesota Statute 270.41, Subdivision 5 to allow Assessors and other qualified employees to perform certain real estate appraisal activities in the City on behalf of the City provided that the governing body adopts a formal resolution specifying the purposes for which the work will be done; and WHEREAS, the Brooklyn Center City Council finds that is in the best interest of the City and its citizens for qualified employees of the Assessing Division to perform real estate activities on behalf of the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that qualified employees within the Assessing Division who hold real estate appraisal licenses be and hereby are allowed to perform real estate appraisal activities in and on behalf of the City which are related to condemnations, right -of -way acquisitions, or special assessments.
