HomeMy WebLinkAbout1992-128 CCRMember Celia Scott introduced the following resolution and moved its adoption: RESOLUTION DECLARING A PUBLIC NUISANCE AND ORDERING THE REMOVAL OF DISEASED TREES (ORDER NO. DST 06/08/92 WHEREAS, a Notice to Abate Nuisance and Diseased Tree Removal Agreement has been issued to the owners of certain properties in the City of Brooklyn Center giving the owners twenty (20) days to remove diseased trees on the owners' property; and WHEREAS, the City can expedite the removal of these diseased trees by declaring them a public nuisance: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL of the City of Brooklyn Center, Minnesota that: 1. The diseased trees at the following addresses are hereby declared to be a public nuisance: PROPERTY OWNER KENNETH TROMBLEY JANE DITZLER JANE DITZLER CITY OF B.C. CITY OF B.C. CITY OF B.C. CITY OF B.C. CITY OF B.C. RESOLUTION NO. 92 -128 PROPERTY ADDRESS 7049 PERRY AVE N 707 69TH AVE N 707 69TH AVE N ORCHARD /FREEWAY WALL CENTRAL PARK /S. LOT CENTRAL PARK /S. LOT WILLOW LANE PARK ORCHARD /FREEWAY WALL TREE NUMBER 1 2 3 4 5 6 7 8 2. After twenty (20) days from the date of the notice, the property owner(s) will receive a second written notice providing five (5) business days in which to contest the determination of the City Council by requesting, in writing, a hearing. Said request shall be filed with the City Clerk. 3. After five (5) days, if the property owner fails to request a hearing, the tree(s) shall be removed by the City. Deputy City Clerk Mayor The motion for the adoption of the foregoing resolution was duly seconded by member Dave Rosene and upon vote being taken thereon, the following voted in favor thereof: Todd Paulson, Celia Scott, Jerry Pedlar, Dave Rosene, and Philip Cohen; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
