HomeMy WebLinkAbout2007 04-26 PCMMINUTES OF THE PROCEEDINGS OF THE PLANNING COMMISSION OF THE CITY OF BROOKLYN CENTER IN THE COUNTY OF HENNEPIN AND THE STATE OF MINNESOTA STUDY SESSION APRIL 26, 2007 CALL TO ORDER The Planning Commission meeting was called to order by Chair Pro Tern Roche at 7:02 p.m. ROLL CALL Chair Pro Tern Tim Roche, Commissioners Graydon Boeck, Gary Ford, Rachel Lund, and Della Young were present. Also present were Community Development Director Brad Hoffinan, Secretary to the Planning Commission/Planning and Zoning Specialist Ronald Warren, and Planning Commission Recording Secretary Rebecca Crass. Chair Sean Rahn and Commissioner Michael Parks were absent and excused APPROVAL OF MINUTES - APRIL 12.2007 There was a motion by Commissioner Ford, seconded by Commissioner Boeck, to approve the minutes of the April 12, 2007 meeting as submitted. The motion passed. Commissioner Lund abstained as she was not present at the meeting. CHAIR'S EXPLANATION Chair Pro Tem Roche explained the Planning Commission's role as an advisory body. One of the Commission's functions is to hold public hearings. In the matters concerned in these hearings, the Commission makes recommendations to the City Council. The City Council makes all final decisions in these matters. APPLICATION NO. 2007-008 SETH OLIVER BROOKLYN HOTEL PARTNERS. LLCI Chair Pro Tern Roche introduced Application No. 2007-008, a request for Planned Unit Development Amendment and development plan approval of the first phase of a two building hotel complex consisting of an eight story, 175 room hotel, 100 seat restaurant and an enclosed connection to the Earle Brown Heritage Center. Mr. Warren presented the staff report describing the location of the property and the proposal. (See Planning Commission Information Sheet dated 4-26-06 and the Director of Public Works/City Engineer's memo dated 4-23-07, for Application No. 2007-008, attached.) A Planned Unit Development rezoning from C 1 A to PUD/C 1 A and development plan approval for a four and seven story, 250 room hotel with a 100 seat restaurant and a 32,000 sq. ft. water park including an enclosed walkway connection to the Earle Brown Heritage Center was approved for this same site by the City Council under Planning Commission Resolution No. 2005-97 on June 27, 2005. The applicant is no longer pursuing the hotel/water park proposal and is now seeking a PUD amendment to allow a two building hotel complex with one building containing 175 hotel rooms and a 100 seat restaurant and the second building with 75 rooms. 4-26-07 Page 1 PUBLIC HEARING - APPLICATION NO. 2007-008 There was a motion by Commissioner Ford, seconded by Commissioner Young, to open the public hearing on Application No. 2007-008, at 7:45 p.m. The motion passed unanimously. Chair Pro Tem Roche called for comments from the public. Mr. Kent Oliver, father of applicant Seth Oliver, spoke on behalf of the applicant. He stated that he previously addressed the Commission in 2005 regarding this Application. He responded to the Commission's questions regarding the location of the trash container area which will be inside the building. He added that any electrical devices, or the transformer, will be screened properly and the lighting plan will be provided at a later date and all requirements will be met. Commissioner Boeck asked Mr. Oliver if he was familiar with the Engineer's report regarding an emergency overflow path and asked for clarification regarding what was submitted on the plan. Mr. Brian Morse, SJA Architects, addressed the Commission and pointed out on the plans where the surge overflow areas are located on the site in the ponding area. Commissioer Boeck pointed out to the applicant that the Engineer's report stated that an adequately constructed emergency overflow from the detention pond out to Earle Brown Drive was required and it should be something other than a pipe. Commissioner Young inquired of the applicant as to which access would be used during construction. Mr. Morse responded that the issue has not been discussed with the contractor but proper use of the site during construction will be followed with access at one or two locations being used and controlling traffic in and out as well as sediment control. Commissioner Young further asked the applicant about their plans for a rain garden during construction. Mr. Morse responded that such details are left to be discussed with the contractor and the City Engineer and to the best of his knowledge a rain garden will not be used. Chair Pro Tern Roche inquired as to the exterior colors of the proposed building. Mr. Morse responded that the building will be complimentary to, but not intended to match, the Earle Brown Heritage Center since they will be connected but will have a reddish brown color with some red accent. Chair Pro Tem Roche asked the applicant when they propose to break ground. Mr. Morse responded that they plan to break ground this summer and hope to be open for business by June 2008. No other persons from the public appeared before the Commission during the public hearing on Application No. 2007-008. CLOSE PUBLIC HEARING There was a motion by Commissioner Lund, seconded by Commissioner Ford, to close the public hearing on Application No. 2007-008, at 7:58 p.m. The motion passed unanimously. 4-26-07 Page 2 The Chair called for further discussion or questions from the Commissioners. The Commissioners interposed no objections to approval of the Application. ACTION TO RECOMMEND APPROVAL OF APPLICATION NO. 2007-008 There was a motion by Commissioner Boeck, seconded by Commissioner Lund, to approve Planning Commission Resolution No. 2007-02 regarding the recommended disposition of Planning Commission Application No. 2007-008 submitted by Seth Oliver (Brooklyn Hotel Partners, LLC). Voting in favor: Chair Pro Tem Roche, Commissioners, Boeck, Ford, Lund, and Young. The motion passed unanimously. The Council will consider the application at its May 14, 2007 meeting. The applicant must be present. Major changes to the application as reviewed by the Planning Commission will require that the application be returned to the Commission for reconsideration. APPLICATION NO. 2007-009 - BROOKLYN CENTER CHURCH OF THE NAZARENE Chair Pro Tem Roche introduced Application No. 2007-009, a request for Special Use Permit and Site and Building Plan approval for a three phase church addition and parking lot expansion at 501 73rd Avenue North. Mr. Warren presented the staff report describing the location of the property and the proposals. (See Planning Commission Information Sheet dated 4-26-07 and the Director of Public Works/City Engineer's memo dated 4-24-07 for Application No. 2007-009, attached.) Mr. Warren explained that the applicant proposes to do the additions and alterations in three phases. Commissioner Lund asked Mr. Warren if there was adequate lighting on the site. Mr. Warren responded that he felt it was adequate as shown on the plan. Commissioner Young asked for further clarification on the screening requirements. Mr. Warren responded that screening should be not confused with security. There are no provisions in the city ordinances that require this property to be secure but rather it has to meet screening requirements in areas where it abuts residential property. He noted the applicant is requesting that he be allowed to provide landscape screening rather than a 6 ft. high opaque fence or wall along the west side where the property abuts R1 zoned property. PUBLIC HEARING - APPLICATION NO. 2007-009 There was a motion by Commissioner Lund, seconded by Commissioner Ford, to open the public hearing on Application No. 2007-009, at 8:48 p.m. The motion passed unanimously. Chair Pro Tem Roche called for comments from the public. Mr. Dean Potts, 10269 Yorktown Lane, Maple Grove, pastor of the church introduced himself to the Commission. 4-26-07 Page 3 Commissioner Ford asked if they have a plan to screen the northerly properties. Mr. Potts responded that they plan to fill in that area with Evergreens. Chair Pro Tem. Roche asked about the location of a sidewalk area leading to the bus shelter. Pastor Potts responded that it allows then access to a proposed drop off lane during Phase I and a possible area for a trash enclosure in the future. Chair Pro Tem. Roche pointed out the City Engineer's comments regarding the proposed retention basin specifically that it may not have to be as deep as it is proposed which could create cost savings. Mr. Potts noted that he had reviewed the City Engineer's comments and they would be looking at that area again in light of his comments. Chair Pro Tem. Roche asked if they have an estimated time line to complete all three phases. Mr. Potts responded that they do not have a time line in mind for the entire project but hope to have Phase I completed by the end of the year. Chair Pro Tern noted that this church has not seen any improvements in years. Mr. Potts acknowledged that and stated that since this parking lot will also be used by Metro Transit for a Park and Ride lot, they will be assisting with some of the cost to the improvements of the parking lot. Chair Pro Tem. Roche suggested to Mr. Potts that they consider `stepping up' the landscaping to create a more aesthetically pleasing look to the area. No other persons from the public appeared before the Commission during the public hearing on , Application No. 2007-009. CLOSE PUBLIC HEARING There was a motion by Chair Pro Tern Roche, seconded by Commissioner Ford, to close the public hearing on Application No. 2007-009, at 9:03 p.m. The motion passed unanimously. There was discussion by the Commission regarding fencing and screening on the site and whether additional screening should be a requirement. It was the consensus of the Commission to add a condition of approval that would require both a 6 ft. opaque fence and additional coniferous trees along the residential property abutting the church property on the west side except where the property abuts the city pump house. The Commissioners interposed no objections to approval of the Application. ACTION TO RECOMMEND APPROVAL OF APPLICATION NO. 2007-009. BROOKLYN CENTER CHURCH OF THE NAZARENE There was a motion by Commissioner Lund, seconded by Commissioner Young, to recommend to the City Council that is approve Application No. 2007-009, submitted by Brooklyn Center Church of the Nazarene, for Special Use Permit and Site and Building Plan approval for a three phase building addition and parking lot expansion for the Church of the Nazarene located at 501 73rd Avenue North subject to the following conditions: 1. The building plans are subject to review and approval by the Building Official 4-26-07 Page 4 with respect to applicable codes prior to the issuance of building permits. 2. Grading, drainage, utility and erosion control plan are subject to review and approval by the City Engineer prior to the issuance of permits. 3. A site performance agreement and supporting financial guarantee in an amount to be determined based on cost estimates shall be submitted prior to the issuance of building permits. 4. Any outside trash disposal facilities and roof top or on ground mechanical equipment shall be appropriately screened from view. B612 curb and gutter shall be provided around all parking and driving areas. 6. An as built survey of the property, improvements and utility service lines shall be submitted to the City Engineering Department. 7. All work performed and materials used for construction of utilities shall conform to the City of Brooklyn Center's current standards specifications and details. 8. The applicant shall provide appropriate erosion and sediment control devices on site during construction as approved by the City Engineering Department and shall obtain an NPDES construction site erosion control permit from the Minnesota Pollution Control Agency prior to disturbing the site. 9. A special use permit is granted to the Brooklyn Center Church of the Nazarene to expand the church in the proposed three phase development and to provide for a Metro Transit Park and Ride facility as comprehended by these plans. Any expansion or alteration of this site, not comprehended by the zoning ordinance or by these approved plans shall not be authorized and would be subject to an amendment to the special use permit. 10. The special use permit is subject to all applicable codes, ordinances and regulations. Any violations thereof could be grounds for revocation. 11. The plans shall be modified to provide a 6 ft. high opaque fence along the west property line to screen all RI zoned property except for the City's well house property. Voting in favor: Chair Pro Tem Roche, Commissioners, Boeck, Ford, Lund, and Young. The motion passed unanimously. The Council will consider the application at its May 14, 2007 meeting. The applicant must be present.
