Member Jerry Pedlar introduced the following resolution and
moved its adoption:
RESOLUTION APPROVING AGREEMENT WITH COMMERCIAL
PARTNERS /BROOKDALE SQUARE
WHEREAS, as per the Declaration of Covenants and Construction Agreement
for a Traffic Control Signal, recorded with Hennepin County as Document No.
4631214, the City of Brooklyn Center now deems the installation of a Traffic
Control Signal at the entrance to Brookdale Square necessary and in the best
interest of the City; and
WHEREAS, Traffic Signal Improvement Project No. 1988 -24 was established
by Resolution No. 88 -183 dated November 7, 1988; and
WHEREAS, the City of Brooklyn Center and Commercial Partners /Brookdale
(hereinafter referred to as the "Owner wish to enter into an agreement for
certain geometric improvements to the roadway in the vicinity of Brookdale
Square and the resulting reconfiguration of a part of the driveway and parking
area within the Brookdale Square property; and
WHEREAS, a "Petition and Waiver Agreement" providing for the making of
the proposed improvements by the City of Brooklyn Center, providing for cost
distribution for those improvements, and specifying other assurances and waivers
has been prepared, submitted to and reviewed by the City Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL of the City of
Brooklyn Center, Minnesota, that:
1. The Petition and Waiver Agreement between the City of Brooklyn
Center and Commercial Partners /Brookdale which provides for the
following improvements and cost estimates for those improvements is
hereby approved.

RESOLUTION NO. 89 -136
2. The Mayor and City Manager are hereby authorized and directed to
execute said agreement in behalf of the City of Brooklyn Center.

The motion for the adoption of the foregoing resolution was duly seconded by
member Celia Scott and upon vote being taken thereon, the following
voted in favor thereof: Dean Nyquist, Celia Scott, Todd Paulson, and
Jerry Pedlar;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
