April 24, 1989 Date Clerk RESOLUTION NO. 89-80 RESOLUTION EXTENDING MORATORIUM ON DEVELOPMENT OF ADULT HALFWAY COMMUNITY BASED RESIDENTIAL FACILITIES AND SIMILAR FACILITIES WHEREAS, on October 26, 1987, the City Council adopted Resolution No. 87 201 which authorized a study pertaining to regulation of adult halfway houses, community based residential facilities and similar facilities and placing a moratorium on the development of such uses; and WHEREAS, on October 10, 1988, the City Council adopted Resolution No. 88- 170 extending the moratorium on the development of such uses until April 30, 1989; and WHEREAS, the studies authorized by said Resolution are in progress but have not yet been completed; and WHEREAS, additional time is needed to complete said studies; and WHEREAS, the reasons for imposing a moratorium on such uses which existed at the time of the adoption of Resolution No. 87 -201 and 88 -170 continue to exist. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that the Council finds and determines that the adoption of the following is necessary to protect the ongoing planning process in the City and to ensure the health, safety and welfare of the residents of the City of Brooklyn Center: 1. The moratorium adopted on October 26, 1987, by Resolution No. 87 201 on the development of adult halfway houses, residential facilities, community -based residential facilities, and community correctional facilities and which was extended to April 30, 1989 by City Council Resolution No. 88 -170 is hereby again extended pending completion of the study authorized by said Resolutions and the adoption of any amendments to the City's Zoning Ordinance. No license (other than renewals), special use permit, or building permit may be issued for such uses during the moratorium period nor may any rezonings, plattings or replattings, or land divisions or consolidations be granted by the City for such uses during the moratorium period. The moratorium period shall expire on August 31, 1989 or such earlier date, as may be further adopted by a resolution of the City Council. The moratorium period may be extended for a reasonable period of time, as determined by a resolution of the City Council, that may be necessary to complete the study and adopt any necessary amendments to the City's Zoning Ordinance. 2. The moratorium shall not apply to any use that meets the definitions of a residential facility as defined in Minnesota Statutes, Section 245.782, subd. 6 and which is regulated by Minnesota Statutes, Section 245.812, subd. 3 and 4 Section 462.357, subd. 7 and 8. Mayor 1 1 RESOLUTION NO. 89 -80 The motion for the adoption of the foregoing resolution was duly seconded by member Jerry Pedlar and upon vote being taken thereon, the following voted in favor thereof: Dean Nyquist, Gene Lhotka, Celia Scott, Todd Paulson, and Jerry Pedlar; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
