HomeMy WebLinkAbout1986-175 CCR1 1 Member Celia Scott moved its adoption: RESOLUTION DECLARING A PUBLIC NUISANCE AND ORDERING THE REMOVAL OF DISEASED SHADE TREES (ORDER NO. DST86 -2) WHEREAS, a Notice to Abate Nuisance and a Notice of Non Compliance with the Order to Abate the Nuisance have been issued to the owners of certain properties in the City of Brooklyn Center; and WHEREAS, the owners of said properties have failed to abate the nuisance as ordered: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL of the City of Brooklyn Center, Minnesota that: 1. The diseased shade trees at the following addresses are hereby declared to be a public nuisance. PROPERTY OWNER David L. Jensen October 13, 1986 Date ATTEST: 4. x( Clerk introduced the following resolution and RESOLUTION N0. 86 -175 PROPERTY ADDRESS TREE NUMBER(S) 5501 Brooklyn Boulevard 361 2. The property owners are hereby given five (5) business days in which to contest the determination of City Council by requesting a hearing in writing. Said request shall be filed with the City Clerk. 3. After five (5) days, if the property owner fails to request a hearing, the trees shall be removed by the City. 4. All removal costs, including legal, financing and administrative charges, shall be specially assessed against the property. /I Mayor if.---7...e..e The motion for the adoption of the foregoing resolution was duly seconded by member Bill Hawes and upon vote being taken thereon, the following voted in favor thereof: Dean Nyquist, Gene Lhotka, Celia Scott, Bill Hawes, and Rich Theis; and the following voted against the same: none, whereupon said resolution was declared duly and adopted.
