Background: Background: The concept review process is an opportunity for the City Council to review a development concept prior to a formal proposal from an applicant, and provide comments, ask questions, and indicate whether the City would be open to the project. The concept review process is helpful for projects that would involve EDA-owned land or public subsidy, as it provides insight to City staff and the applicant regarding the City Council’s level of interest, and any specific concerns related to a project. A concept review is considered advisory and is non-binding to the City and the applicant. No formal action can be taken at a work session, and the Council is not being asked to vote on the proposal; however, as the Subject Property, which is located at 57th and Logan (no address assigned), and comprised of approximately 4.72 acres of Lot 002, Block 001, Northbrook Center 3rd Addition, is owned by the City’s Economic Development Authority (“EDA”), City staff and the applicant seek feedback and direction to inform any next steps. If the applicant chooses to submit a formal application to the City to proceed, it would be subject to the full City review process, as with any other development application. Project Concept: Chutima (“Air”) Gustafson of Morty’s Bark & Brew, LLC (the “Developer” or “Applicant”) has submitted a proposal to purchase approximately 2.5 Acres of the Subject Property to construct a brewery and tasting room, collectively approximately 7,500 square feet, with an out-door, off-leash dog park. The remainder of Lot 002, Block 001, Northbrook Center 3rd Addition not purchased by the Developer would be made available for lease to the Developer from EDA at low cost to be used by the Developer as an extension of the out-door, off-leash dog park until such time as additional development may occur on the leased property. Using the space as an extension of the dog park would activate the space, and provide a public amenity maintained by the Developer. Along the north and east boundaries of Lot 002, Block 001, a bike and pedestrian trail would be installed, connecting the Opportunity Site, via the John Martin Drive bridge over Highway 100 to trails, the pollinator project, and other local amenities, further Page 2 of 54 connecting and activating the area. The concept plan currently shows access off 57th Avenue North and the parking area to the west of the building; however, in the final plan, it is anticipated that the parking and access will be to the north of the building off Logan Avenue North, and under the power lines. Lot 002, Block 001 Northbrook Center 3rd Addition: The Subject Property is approximately 2.5 acres of 4.72-acre parcel located to the east of Trunk Highway (TH) 100 and the 57th Avenue North access to TH 100, to the south of the Extra Storage Space (5721 Logan Ave N), north of 57th Avenue, and west of Logan Avenue North and legally described as Lot 002, Block 001, Northbrook Center 3rd Addition. The City’s Economic Development Authority acquired the Subject Property in a strategic acquisition of the larger overall parcel bordered by Logan Avenue to the east, 57th Avenue to the south and the 57th Avenue North access road to TH 100 to the northwest. The parcel was acquired via eminent domain in 2005 and the City enrolled the property in the Minnesota Pollution Control Agency’s (“MPCA”) Volintary Investigation and Clean-up Program (“VIC”) to address the investigation of contaminants found on the north end of the parcel associated with a former dry cleaning facility. Available records indicate that a dry cleaning facility operated north of the site from approximately 1966 until sometime in the late 1980s or early 1990s. The specific contaminants of concern were Tetrachloroethylene (“PCE”) and Trichloroethylene (“TCE”), both of which are Volatile Organic Compounds (“VOC’s”). Environmental investigations conducted by the City’s environmental consultant in 2005 indicated the presence of PCE and TCE contamination in ground water and soil vapor east and southeast of the former dry cleaning facility. City staff initiated communication with the MPCA in November 2024, who informed staff the Subject Property falls outside the Superfund Hmong American Shopping Center remedial site. There is a Leak Site (LS) identified as the Bill West Service Center Leak #3840 and petroleum brownfields (PB) site identified as the Former Acme Typewriter PB33531 on the Subject Property, and the MPCA recommends completion of a Phase I environmental review or NAD ("No Association Determination") prior to any proposed redevelopment of the Subject Property. The Property is zoned Neighborhood Mixed-Use (MX-N1), which allows for a brewery and tasting room as a use. Development Agreement: Page 3 of 54 The EDA is in negotiations with Developer regarding the specific terms of a development agreement to be proposed at a later date. EDA anticipates that the purchase price for the Subject Property will be approximately $500,000. EDA anticipates that any future development agreement will require an earnest money payment to EDA of $10,000 and will include a reverter clause allowing EDA to re-enter and re-possess the property in the event Developer does not substantially complete improvements within the term of the development agreement. Next Steps: If the Council wishes to proceed, the EDA and Developer will continue negotiating the terms of a development agreement and will present the development agreement for consideration at a future meeting. The Developer will conduct its due diligence on the Subject Property and prepare a Planning Commission application, with full architectural and civil plan sets. This application would go through full review with City staff, the Planning Commission, and City Council. Should a recommendation for approval of the project be granted, City staff would negotiate a purchase agreement for the Subject Property, which would go to the City EDA for consideration, and as part of a public hearing. The Developer is not seeking public subsidy as part of its proposal at this time. Budget Issues: The Subject Property was acquired by the City of Brooklyn Center Economic Development Authority as part of the eminent taking of a larger parcel and total environmental monitoring costs associated with the larger parcel are $457,590.00, of which $155,227 were TIF 3 expenses. The Subject Property is a portion of the larger parcel. The City’s Tax Increment Financing Plan identifies the following objectives in establishing the aforementioned District: 1. To enhance the tax base of the City; 2. To provide maximum opportunity, consistent with the needs of the City for development by private enterprise; 3. To better utilize vacant or underdeveloped land; 4. To attract new business; 5. To acquire blighted or deteriorated residential property for rehabilitation or clearance and redevelopment; and 6. To develop housing opportunities for market segments underserved by the City, including housing for the disabled and elderly. If the applicant chooses to submit a formal application to the City to proceed, it would be subject to the full City review process, as with any other development application. Project Concept: New Horizon Academy (the “Developer” or “applicant”) has submitted a proposal to purchase the Subject Property to construct a child daycare facility approximately 12,500 square feet. The developer is currently located at 6842 Humboldt Avenue North, in a facility that is approximately 6,000 square feet and desires to move to a larger, updated facility to accommodate more students and increase its preschool offerings. A larger location in Brooklyn Center is in line with expanded locations in Crystal and Maple Grove. New Horizon Academy began business in 1971 in Brooklyn Center. New Horizon Academy has been a part of Brooklyn Center since it opened and is motivated to remain in Brooklyn Center in a new and updated facility. New Horizon Academy has been Page 16 of 54 seeking an appropriate space for its new facility within Brooklyn Center for over a year without success. New Horizon Academy has been in contact with Community Development for months requesting assistance in locating appropriate property and sought opportunities within Brooklyn Center’s EDA-owned properties. New Horizon Academy current lease will expire in 2026, and is seeking to be located at a new facility by third quarter 2025; therefore time is of the essence. Brooklyn Center would benefit from additional daycare resources for its residents, as 9% of residents are under the age of 5. New Horizon Academy has been a part of the Brooklyn Center business community for decades and provides a highly sought after early childhood education program. Redevelopment of the Subject Property would support the City’s strategic priorities supporting economic growth and jobs development. 7000 and 7014 Brooklyn Boulevard and 7015 Kyle Avenue North: The Subject Property is a combined parcel consisting of 3 parcels with a total of approximately 1.47 acres of land located on the east side of Brooklyn Boulevard. This location has previously been considered for an additional municipal liquor store location; however, no action has been taken. The Property is zoned Neighborhood Mixed-Use (MX-N2) and allows for smaller scale commercial developments of 10,000 square feet or less, therefore discussions between City staff and Developer are ongoing to pursue solutions. The preliminary concept plan will require the Developer to obtain an easement from the adjacent property owner. Development Agreement: EDA has not yet begun negotiations with Developer regarding the specific terms of a development agreement. EDA anticipates that any future development agreement will require an earnest money payment to EDA of $10,000 and will include a reverter clause allowing EDA to re-enter and re-possess the property in the event Developer does not substantially complete improvements within the term of the development agreement. Negotiations regarding the Developer’s proposed purchase price are ongoing and no firm offer has been made. EDA anticipates that the purchase price may be equal to acquisition costs. Not many people know that New Horizon Academy began in the city of Brooklyn Center, when my mom opened the doors of her first early childhood classroom in 1971. In 2024, our schools were honored with awards in nearly every community we serve, including Minnesota’s Best Childcare by the Star Tribune and Favorite Childcare by Minnesota Parent. These recognitions are a testament to exceptional early childhood education experiences created in our classrooms. Additionally, for the eighth consecutive year, New Horizon Academy was named a Star Tribune Top 200 Workplace by our employees. For the fourth consecutive year, we were also named a Top Workplace by USA Today. We have been continuously serving Brooklyn Center families for over 53 years and currently operate a small school located at 6842 Humboldt Avenue North. However, our current facility is tired, and numerous negotiations with our landlord for improvements have been unsuccessful. If we do not find a viable replacement option before our lease expires, enrolled families will be displaced, and the community will lose this cherished asset. More importantly, we want the ability to serve more families who want and need our care, and we simply do not have the capacity in our current building to serve additional children. We have been tirelessly searching for a suitable site to build a larger school that would replace our existing program on Humboldt Avenue North. We have sent 30+ letters to the other property owners, without any success. Additionally, we have explored the following properties without success as well: • 5501 Xerxes Ave – This was the former Big O Tires. Seller went with a different offer which is now a state automotive inspection center. • Gatlin / Shingle Creek Crossing – Lot’s L, T, and Q. Gatlin won’t engage with us on Lots L or T. Lot Q has flood plain issues that cannot be resolved in time for us to complete construction prior to the expiration of our current lease. • 5637 Brooklyn Blvd – Owner was initially interested in selling the property but decided to hold off. • 5927 John Martin Dr – This was a former tire shop and now houses the Asian Buffet. City said no to our use in this location. • 6405 James (Denny’s) – City won’t allow the use. • 57th & Hwy 100 - City owned land that was presented to us. We had interest in this location but the City subsequently told us to hold off due to MnDOT making changes to the John Martin bridge. (Church we previously occupied) - Pastor indicated that the church is viable and not an alternative for us. • 2300 Freeway (BAPS) – The building is too large and very costly to remodel as a child care center. • 2500 Freeway - City has indicated our use would not be supported at this location. We would pursue if City were to be supportive. • 7100 Brooklyn Blvd - Currently on the market for lease only. • City of Brooklyn Center owned land (Shingle Creek and Bass Lake Road) – City has plans for a larger, master planned development. Not available to us at this time. • SW Corner of Brooklyn Blvd & Bass Lake Road – This lot is too small. It subsequently was sold to another party. We have now identified a site in Brooklyn Center that would work for our use, however it is currently owned by the city. The property is located at 7014/7000 Brooklyn Blvd / 7015 Kyle Ave. We are interested in these parcels and would like to explore further with the City. The opportunity to develop a larger, state-of-the-art child care facility will allow us to increase our capacity – spaces (from 118 to 176 children) that we are confident will be quickly filled by Brooklyn Center families in need of care. We strive to provide the best early childhood experiences for young children so they can become capable and resilient lifelong learners. We do this in part by maintaining accreditation with the National Association for the Education of Young Children and the highest possible rating from Parent Aware, Minnesota’s quality rating and improvement system for child care providers. We are on the City Council agenda on Monday, January 13th to seek your input on the development of these parcels. In addition, we are happy to schedule a time to tour any one of our nearby schools and/or to further discussion on the subject City owned parcels. Peter Hilger, AIA philger@rylaur.com RE: Proposal for New Horizon Academy 70th & Brooklyn Blvd. North Please find the attached preliminary, and documentation necessary for the city of Brooklyn Center to review the feasibility of a childcare facility on this city owned parcel. This is a request for the city to evaluate the general feasibility of the project on this particular site. ABOUT NEW HORIZON ACADEMY New Horizon Academy is a high-quality early learning provider that is 4-Star Parent Aware rated and accredited by the National Association for the Education of Young Children (“NAEYC”), the gold standard in the early childhood industry. New Horizon Academy has been serving metro area families since 1971. In fact, New Horizon Academy opened its first school in Brooklyn Center at 1200 69th Avenue N. Currently, it operates a school located at 6842 Humboldt Avenue N. Their current facility is tired, and numerous negotiations with their landlord for improvements to their school and the overall development have been unsuccessful. As such, New Horizon Academy would like to find a viable replacement option where it can build a new first-class school that will also increase the capacity in order for it to serve more families in the Brooklyn Center community. They have looked tirelessly for a viable option without success. Please see attached letter from New Horizon Academy. If it does not find a viable replacement option before their lease expires in 2026, enrolled families will be displaced, and the community will lose this cherished asset. This new school will be a first-class, customized prototype to meet the site and building program criteria. It will include a large indoor motor room, 3 playgrounds; have increased capacity and additional programming features that their current location is unable to provide. ABOUT THE SITE The site is located on the northeast corner of 70th and Brooklyn Blvd. on three parcels roughly 64,000 SF; PID’s: 2711921330067, 2711921330008, and 2711921330007. The site is currently zoned MX-N2 Neighborhood Mixed Use. Childcare is an approved use by Conditional use Permit, as presently applied, and is consistent with the City’s Comprehensive Plan. Limited to 10,000 SF of gross building area on this site, we are respectfully requesting a variance to increase to our desired capacity of roughly 12,450 SF +/- in order to serve more children. The proposed use as a childcare center does not generate any environmental concerns, nor does it generate noise (except children at play – hopefully deemed a pleasant sound). Hours of operation are generally 6:00 AM to 6:30 PM, Monday through Friday. New parking lot and building lighting is proposed to be glare free and energy efficient. Page 21 of 54 - 2 - Rylaur, LLC 14 Pheasant Lane North Oaks, MN 55127-2512 612-868-3636 A Phase 1 Environmental Evaluation, geotechnical evaluation and ALTA survey will be completed as part of normal site due diligence, along with preliminary stormwater management analysis. The site is sufficiently large enough to accommodate some stormwater management systems onsite along with adequate parking and sufficient play space. The size and triangular shape of the property does constrain its development in the following ways: 1. There is no direct access from Brooklyn Blvd, and the only site access is via Kyle Ave North, an unimproved street that has access issues with the present geometry of the intersection turn lanes. 2. The access to Kyle Ave. N. would have to be relocated farther east outside of the present right of way for Kyle Ave. onto the church property. Not having a left turn into Kyle Ave. N from eastbound 70th Street effectively makes the parcel functionally unusable since most of the traffic bound for this site for practically any use will be from the more recently upgraded Brooklyn Boulevard intersection. 3. The city requires the main building façade and entrance face the street, with parking excluded from the front yard. In order to make that work, the school entrance would be at the tightest possible spot on the site where three street frontages converge, facing the 70th Street frontage and the intersection. This poses design challenges for the preferred site plan. A prototypical New Horizon Academy would typically face the street it is being accessed from, in this case Kyle Ave. N. with parking at the front of the building. These are significant issues that we would need to mutually resolve. However, based upon the very schematic site concept plan developed and submitted with this narrative, we can make our program work on this site to the benefit of the City and NHA’s current and future families. BUILDING AND OCCUPANCY At 12,450 SF+/-, this single-story building is intended to visually blend with, and improve the general characteristics of its commercial neighbors. The child care program breaks down as follows: Infants: 2 rooms @12 = 24 Transition: 1 room @14 = 14 Toddler: 2 rooms @14 = 28 Preschool: 4 rooms @20 = 80 Preschool K: 1 room @ 30 = 30 TOTAL CHILD COUNT: 176 + 28 staff Typical Industry Occupancy Rate 80% (conservative) TOTAL Planned Population Daily Density: 141 With accessory spaces as follows: Large Motor Play Space: 1200 SF for use by occupants Various Storage, Service and Administrative functions Page 22 of 54 - 3 - Rylaur, LLC 14 Pheasant Lane North Oaks, MN 55127-2512 612-868-3636 Operationally, on any typical operating day during the school year at New Horizon’s typical existing centers, daily attendance averages 143 children (typical school capacity is 172 children, 75% occupancy rate) and 23 staff, including families that have two children attending. The average for childcare centers generally is a 70% occupancy rate at any given time. It is important to note that licensed capacity is strictly focused on design standards for classrooms and play spaces. Occupancy fluctuates and does not often exceed 80% of licensed capacity. Finally, many staff also have their own children in the program, or also rely on public transportation, ride sharing, and other means to access the site. A segregated trash enclosure is proposed on the north side of the property, proposed to be constructed of similar materials to match the building. The building will be classified as Type V-N construction, I-4 occupancy with a new fire sprinkler system for the entire building. ARCHITECTURE The New Horizon prototypical architecture features a stone base coursing below the window line, a generous array of large windows, several forming the building corners to the classrooms, twin stone feature elements that flank a canopied entrance, capped by a band of alternating board and batten panels. The lower and upper halves of the typical elevation are separated by a thin New Horizon blue line. New Horizon has developed several different building styles to suit different neighborhood criteria and is not opposed to reasonable modifications to customize this design. See photo below of one of our locations where we implemented solar panels. Figure 2: Photo of our recently opened Meridian, Idaho solar panels PLAY SPACES New Horizon Academy is committed to well-designed play-spaces, ones that do not rely solely upon large motor skill equipment, but also some natural elements that invite a child’s explorative curiosity in keeping with their mission. The plans call for the three different play areas (infant, toddler, and preschool). Additionally, the play areas will utilize best practices for safety. The play areas are all designed well above the licensing standard minimum areas, expected to be sized roughly as follows: (subject to final site design): • Infant area: 700 SF +/- for 12 children = maximum one room per play (crawl) session • Toddler Area: 5400 SF +/- for 28 children = maximum two rooms max per session • Preschool Area: 7,500 SF +/- for 110 children = maximum 2 or 3 classrooms per session FENCING, LANDSCAPING AND SCREENING Each of the three age-segregated play areas are proposed to be fenced with a 6’-0” high black steel ornamental picket style (no screening or opacity) where fronting a property boundary. Internal fences separating play spaces from each other are 5’ high (such as between Toddler and Preschool play-spaces. The fence is set back a minimum of 5’ from the property. All fence gates would be secured with panic hardware and exit alarms. Page 24 of 54 - 5 - Rylaur, LLC 14 Pheasant Lane North Oaks, MN 55127-2512 612-868-3636 The proposed landscape is designed for a variety of species, densities and textures. Landscaping is not specifically called for within the play spaces due to lack of survivability in that environment. It is hoped, once a final survey is completed showing species, location and size, that several specimen trees can be preserved. The landscape will be fully irrigated with a system using water efficient technologies such as water saving sensors, a flow meter, and dripline in the planting beds. PARKING AND CIRCULATION Section 35-5506 of the Unified Development Code does not appear to provide a specific parking requirement for childcare use. Paragraph (d) of that section states that for uses not covered by the list, the minimum shall be the number of “spaces as required for the most similar use as determined by the Zoning Administrator”. We are proposing a 42-stall parking facility with a turnaround at the north end adequate for fire apparatus. While Kyle Avenue North technically exists as a street, it is currently not constructed as a street. Further, the site, by virtue of its size and shape, with the small end of the “pie shape” closest to 70th Street, it is believed that a left turn into the site once exiting onto 70th from Brooklyn Blvd will not be possible. A median exists separating two lanes westbound whose geometry will not adequately provide for a left turn lane a suitable centering distance from Brooklyn Blvd for any future use on this site. Therefore, a repositioning of the present Kyle Avenue North curb cut eastward may be necessary to access this site. Children are not dropped off at the sidewalk or parking lot. Every child is brought into the center by their caregivers. Stalls along the front of the building are typically reserved for this function, the peak time of which is 7-10 AM and 3:30 – 6:30PM. The time of stall occupancy is fairly short, typically 5-10 minutes maximum. New Horizon Academy has extensive experience understanding its parking needs along with other data to support our design. First, the Institute of Traffic Engineers (ITE) Parking Generation Manual has established three separate calculation metrics: • A rate of 0.24 spaces per student, Using 0.24 X 176 students = 42 parking stalls, equal to what we propose. • An average of 2.45 stalls per 1,000 SF = 12,450 SF gross X 90% = 11,205 SF net/1,000 = 11.2 X 2.45 = 27 parking stalls • An average of 1.22 spaces per employee = 29 X 1.22 = 35 parking stalls Averaging these three factors yields a parking stall count of 35 stalls, less than the 42 stalls we are proposing. Second, New Horizon Academy has commissioned a traffic study of their existing Apple Valley center, of a similar though slightly smaller size, to provide empirical evidence of the licensed occupant load calculations and their impact on parking. That school is consistently highly enrolled, and the study was completed during a period where occupancy was 83%. Please see attached traffic study. Page 25 of 54 - 6 - Rylaur, LLC 14 Pheasant Lane North Oaks, MN 55127-2512 612-868-3636 Following are the actual peak hour and 14-hour total traffic trip generation for a typical week at the existing centers of similar size and design: The following chart summarizes the density of use of the parking lot from the Apple Valley center from 5:30 AM - 7:30 PM: From this study, the maximum number of occupied parking spaces at any given time was 24, occurring at 8:00 AM during the morning peak. Furthermore, there is plenty of regional justification for a lower standard. Rylaur has designed over 100 childcare centers around the city and country, and offers the following examples of parking densities for similarly designed and managed facilities in suburban locations: Though this data is for a smaller capacity center, the data suggests an average of 5.42 occupants per stall, meaning our 42 stall parking lot could support 227 occupants, well above our planned capacity. Based upon this evidence from three separate source calculations, we respectfully request the parking determination to properly reflect the proposed design. NEXT STEPS New Horizon Academy, as a long-time employer and childcare service in the city, respectfully requests that: 1) the city enter into a purchase and development agreement to sell the referenced properties; 2) to generally support the development as proposed (subject, of course, to final site plan, conditional use permit, and engineering entitlement approvals); and 3) to lead the critical requirement of solving access to the site by confirming the status of Kyle Ave. North and the limitations of the access geometry resulting from the intersection improvements earlier provided by the State, and if required, alter the geometry and right of way to Kyle Ave. N.
