lution and moved its adoption:
RESOLUTION NO. 81 -268
RESOLUTION ADOPTING ASSESSMENT OF SANITARY SEWER IMPROVEMENT
PROJECT NO. 1981 (EARLE BROWN DRIVE)
WHEREAS, the City Clerk, with the assistance of the City Engineer,
has prepared proposed assessment rolls identifying each and every lot, piece,
or parcel of land to be specially assessed and the amount calculated against
the same, for the following improvement:
Improvement Project ND. 1981 -06:
Installation of Sanitary Sewer in Earle Brown Drive from its
westerly intersection with Summit Drive northerly and easterly
approximately 1,600 feet to the existing cul-de -sac of Earle
Brown Drive; and
WHEREAS, such proposed assessments have been on file with the City
Clerk and open to inspection and copying by all persons interested; and
WHEREAS, pursuant to proper notice duly given as required by law,
the City Council has met and heard and passed upon all objections to such pro-
posed assessments.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL of the City of
Brooklyn Center, Minnesota, as follows:
1. Such proposed assessment, a copy of which shall be certified to
by the City Clerk and filed in his office, is hereby accepted and
shall constitute the special assessment against the lands named
therein, and each tract of land therein included is hereby found
to be beniited by the improvement in the amount of the assessment
levied against it.
2. Such assessments shall be payable in equal annual installments ex-
tending over a period of fifteen years. The first of the install-
ments shall be payable on or before the first Monday in January,
1983, and shall bear interest at the rate of twelve percent per
annum from January 1, 1982, until the amounts have been paid in
full. To the first installment shall be added interest on the en-
tire assessment for twenty -four months from January 1, 1982, until
Decanter 31, 1983. 'Ib each subsequent installment when due shall
be added interest for one year on all unpaid installments.
3. The owner of any property so assessed may at any time prior to
certification of the assessment to the County Auditor, pay the
whole of the assessment, with interest accrued to the date of pay-
ment, to the City Treasurer, except that no interest shall be
charged if the entire assessment is paid within 30 days from the
adoption of this resolution; and he may, at any time thereafter,
pay to the City Treasurer the entire amount of the assessment re-
maining unpaid, with interest accrued to Decanber 31 of the year
in which such payment is made. Such payment must be made before
Novanber 15, or interest will be charged through December 31 of
the succeeding year.

4 The City Clerk shall forthwith transmit a certified duplicate of
this assessment to the County Auditor to be extended on the proper
tax lists of the county, and such assessments shall be collected
and paid over in the same manner as other municipal taxes.

The motion for the adoption of the foregoing resolution was duly seconded by
member Tony Kuefler and upon vote being taken thereon, the
following voted in favor thereof: Dean Nyquist, Tony Kuefler, Bill Fignar,
and Gene Lhotka;
and the following voted against the same: none,
III whereupon said resolution was declared duly passed and adopted.
