and moved its adoption:
RESOLUTION NO. 81 -270
RESOLUTION ADOPTING ASSES 4ENT CE' CCMBINED STREET IMPRCTJEMENT
PROJECT NOS. 1979 -06, 1980 -02, 1981 -02, 1981 -07, AND 1981 -08
WHEREAS, the City Clerk, with the assistance of the City Engineer,
has prepared proposed assessment rolls identifying each and every lot, piece,
or parcel of land to be specially assessed and the amount calculated against
the same, for the following improvements:
Improvement Project Nos. 1979 -06, 1980 -02, 1981 -02, 1981 -07, and
1981 -08:
Street extension of existing Shingle Creek Parkway from City Hall
northward approximately 200 feet to the south end of Bridge No. 27910,
and
Curb and gutter placement on Summit Drive east from Shingle Creek
Parkway to Earle Brown Drive, and
Modification of the existing roadway on Shingle Creek Parkway between
Co. Rd. 10 and F.A.I. 94 to provide turn lanes for continuity of traffic
flow through the Brooklyn Center Industrial Park, and
Installation of storm sewer on Earle Brown Drive adjacent to its
westerly intersection with Summit Drive, and
Construction of street improvements consisting of concrete curb and
gutter, bituminous paving, and minor storm sewer system adjustments on
Farle Brown Drive from its westerly intersection with Summit Drive to
its easterly intersection with Summit Drive; and
WHEREAS, such proposed assessments have been on file with the City
Clerk and open to inspection and copying by all persons interested; and
WHEREAS, pursuant to proper notice duly given as required by law, the
City Council has met and heard and passed upon all objections to such proposed
assessments.
NOW, THERFFORE, BE IT RESOLVED BY THE CITY COUNCIL of the City of
Brooklyn Center, Minnesota, as follows:
1. Such proposed assessment, a copy of which shall be certified to
by the City Clerk and filed in his office, is hereby accepted and
shall constitute the special assessment against the lands named
therein, and each tract of land therein included is hereby found
to be benefited by the improvement in the amount of the assessment
levied against it.
2. Such assessments shall be payable in equal annual installments ex-
tending over a period of fifteen years. The first of the install-
ments shall be payable on or before the first Monday in January,
1983, and shall bear interest at the rate of twelve percent per
annum from January 1, 1982, until the amounts have been paid in
full. To the first installment shall be added interest on the
entire assessment for twenty -four months from January 1, 1982,
until December 31, 1983. To each subsequent installment when due
shall be added interest for one year on all unpaid installments.
3. The owner of any property so assessed may at any time prior to
certification of the assessment to the County Auditor, pay the

whole of the assessment, with interest accrued to the date of
payment, to the City Treasurer, except that no interest shall
be charged if the entire assessment is paid within 30 days from
the adoption of this resolution; and he may, at any time there
after, pay to the City Treasurer the entire amount of the assess-
ment remaining unpaid, with interest accrued to December 31 of the
year in which such payment is made. Such payment must be made
before Novnber 15, or interest will be charged through December
31 of the succeeding year.
4. The City Clerk shall forthwith transmit a certified duplicate of
this assessment to the County Auditor to be extended on the proper
tax lists of the county, and such assessments shall be collected
and paid over in the same manner as other municipal taxes.

The motion for the adoption of the foregoing resolution was duly seconded by
member Tony Kuefler and upon vote being taken thereon, the
following voted in favor thereof: Dean Nyquist, Tony Kuefler, Bill Fignar,
and Gene Lhotka;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
