and moved its adoption:
RESOLUTION NO. 80 235
RESOLUTION APPROVING SUPPLEMENTAL AGREEMENT NO. 3 TO
CONTRACT 1980-A
WHEREAS, the City Engineer has determined that retaining walls must
be constructed at various locations adjacent to the sidewalk along 53rd Avenue
North not previously shown on the construction plans; and
WHEREAS, the installation of specified retaining wall material proved
to be impractical for said locations; and the City Engineer has recommended the
use of cast -in -place concrete retaining walls at a unit price of $11.50 /Sq.Ft.
in lieu of the specified material at $12.00 Sq.Ft.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center that the above modification to the 53rd Avenue I4rovement Project
N. 1978 -39 is hereby approved. It is estimated that said Supplemental Agreement
will result in an increase of $3, 450.00 in the Contract Amount. Funds are to be
appropriated from Municipal State Aid Funds.

The motion for the adoption of the foregoing resolution was duly seconded by
member Gene Lhotka and upon vote being taken thereon, the following
voted in favor thereof: Dean Nyquist, Tony Kuefler, Bill Fignar, Gene Lhotka, and
Celia Scott;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
