HomeMy WebLinkAbout1981-127 CCRMember Gene Lhotka introduced the following resolution and moved its adoption: RESOLUTION NO. 81 -127 RESOLUTION ADOPTING ASSESSMENT OF STREET IMPROVEMENTS TO UNITY AVENUE NORTH WITHIN THE PONDS PLAT SIX WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the following improvement projects: Project Number Description 1978 -35 Storm sewer along proposed Unity Avenue North from the westerly extension of the south line of Outlot F, THE PONDS, northerly approximately 400 feet. 1978 -36 Street grading, base, and surfacing along pro- posed Unity Avenue North from the westerly ex- tension of the south line of Outlot F, THE PONDS, northerly approximately 780 feet to 73rd Avenue North. 1978 -37 Curb and gutter along proposed Unity Avenue North from the westerly extension of the south line of Outlot F, THE PONDS, northerly approxi- mately 780 feet to 73rd Avenue North, collectively referred to as Street Improvements 81 -3. NOW, 'THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL of the City of Brooklyn Center, Minnesota, as follows: 1. The proposed assessment roll, a copy of which has been on file with the City Clerk and open to public inspection, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the improvement in the amount of the assessment levied against it. 2. This assessment shall be designated Levy No. 8023, STREET IlKPRCT\7F- MENTS 81 -3. Such assessment shall be payable in equal annual in- stallments to be payable on or before the first Monday in January, 1982, and shall bear interest at the rate of 13 percent per annum fram July 1, 1981 until the balance is paid in full. To the first installment shall be added interest on the entire assessment from July, 1981, until December 31, 1982. Zb each subsequent install- ment, when entered on the Hennepin County tax rolls, shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may at any time prior to November 15, 1981, pay the whole of the assessment, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid with- in 30 days from the adoption of this resolution. On November 16, 1981, the first installment shall be placed on the tax rolls by the Hennepin County Director of Finance. Each year thereafter, prior to November 15th of that year, the unpaid principal balance for all succeeding years remaining on the levy may be prepaid at the City Hall. RESOLUTION NO. 81 -127 i 4. The City Clerk shall forthwith transmit a certified duplicate of this assessment roll to the Director of Finance of Hennepin County to be extended on the proper tax lists of the county, and such assessments shall be collected and paid over in the same manner as other municipal taxes. F] June 22, 1981 Date ATTEST: C erk Mayor The motion for the adoption of the foregoing resolution was duly seconded by member Bill Fignar and upon vote being taken thereon, the following voted in favor thereof: Dean Nyquist, Tony Kuefler, Bill Fignar, Gene Lhotka, and Celia Scott; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
