Member Gene Lhotka introduced the following resolution and moved its
RESOLUTION NO. 81 -22
RESOLUTION CALLING FOR PUBLIC HEARING PURSUANT TO MINNESOTA
STATUTES, SECTION 474.01, SUBDIVISION 7b
WHEREAS, a proposal has been made to this Council by Federal Lumber
Company, a Minnesota corporation (the "Company to undertake a project (the
"Project pursuant to the Minnesota Municipal Industrial Development Act,
Minnesota Statutes, Chapter 474 (the "Act and
WHEREAS, the Project consists of the acquisition, construction, and
equipping, on land presently owned by the Company within the Municipality, of
an office and warehouse facility; and
WHEREAS, Section 474.01, Subdivision 7b of the Act requires this
Council to conduct a public hearing on said proposal and to publish notice of
said public hearing not less than 15 days nor more than 30 days prior to the
date fixed for the hearing; and
WHEREAS, a draft copy of a proposed application to the Minnesota
Commissioner of Securities, together with all attachments and exhibits thereto,
will be placed on file with the City Clerk;
BE IT RESOLVED by the City Council of the City of Brooklyn Center,
Minnesota, as follows:
1. A public hearing shall be conducted by this Council on the proposal
to undertake and finance the Project on February 23, 1981 at eight o'clock p.m.
at the City Hall, at which hearing all parties who appear shall be given an
opportunity to express their views with respect to said proposal.
2. Notice setting forth the time and place of hearing, the general
nature of the Project and an estimate of the principal amount of bonds or other
obligations to be issued to finance the Project shall be published at least
once not less than 15 days nor more than 30 days prior to the date fixed for the
hearing, in the official newspaper and a newspaper of general circulation of the
City. The notice shall state that a draft copy of the proposed application to
the Minnesota Commissioner of Securities, together with all attachments and
exhibits thereto, shall be available for public inspection following the pub-
lication of such notice and shall specify the place and times where and when it
will be so available.

The motion for the adoption of the foregoing resolution was duly seconded by
member Celia Scott, and upon vote being taken thereon, the following voted
in favor thereof: Dean Nyquist, Tony Kuefler, Bill Fignar, Gene Lhotka, and
Celia Scott; and the following voted against the same: none, whereupon said
resolution was declared duly passed and adopted.
