HomeMy WebLinkAbout1980-066 CCRI, Member Gene Lhotka introduced the following resolution and moved its adoption: RESOLUTION NO. 80 -66 RESOLUTION REGARDING DISPOSITION OF PLANNING COMMISSION APPLICATION NO. 80004 SUBMITTED BY MR. WILLIAM NORENBERG WHEREAS, Planning Commission Application No. 80004 was submitted by Mr. William Norenberg on December 27, 1979 requesting a special use permit for a home occupation to build kitchen cabinets in the garage of his home at 5338 Emerson Avenue North; and WHEREAS, the Planning Advisory Commission considered the request at a duly called public hearing on January 10, 1980 at which time testimony both for and against the petition was taken; and WHEREAS, the City Council considered the request at a duly called public hearing on January 28, 1980 at which time testimony both for and against was taken; and WHEREAS, the application was tabled by the City Council for one month to allow the applicant and neighboring property owners to meet and resolve differences relating to the request; and WHEREAS, the City Council again considered the application at a duly called City Council meeting on February 25, 1980 at which time it was reported that the applicant and the neighboring property owners had not resolved their differences. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center to deny Planning Commission Application No. 80004 submitted by Mr. William Norenberg for a special use permit for a home occupation to build kitchen cabinets in the garage of his home at 5338 Emerson Avenue North on the basis that the Standards for Special Use Permits are not met particu- larly with respect to the following: 1. The operation as proposed would result in noise and /or vibrations perceptible beyond the boundaries of the premises which, in this instance, are considered to be detrimental to the health and comfort of neighboring property owners. 2. The proposed hours of operation are considered excessive and the full utilization of the hours for the proposed home occupation are deemed to be injurious to the use and enjoyment of other property in the immediate vici 'ty.
