HomeMy WebLinkAbout2025-034 CCRMember Jerzak introduced the following resolution and moved its adoption: RESOLUTION NO. 2025-034 RESOLUTION SUPPORTING THE PURSUIT OF A MINNESOTA'S ENVIRONMENT AND NATURAL RESOURCES TRUST FUND GRANT FOR LAND ACQUISITION OF NINE PARCELS LOCATED AT 1000, 1020, 1050, 1100, AND 1150 SHINGLE CREEK CROSSING FOR THE PURPOSE OF DAYLIGHTING SHINGLE CREEK WHEREAS, the Legislative -Citizen Commission on Minnesota Resources (LCCMR) has opened Request for Proposals for the Environment and Natural Resources Trust Fund (ENRTF); and WHEREAS, the ENRTF has approximately $103 million available and will accept applications that aim to protect, conserve, preserve, and enhance Minnesota's air, water, land, fish, wildlife, and other natural resources; and WHEREAS, the City of Brooklyn Center seeks $6,000,000.00 from the ENRTF to acquire nine parcels with PIDs 0211821320024, 0211821320029, 0211821320025, 0211821320030,0211821320031,0211821310063,0211821310058,0211821310064,and 0211821310065 for the purpose of daylighting Shingle Creek which runs under the subject parcels. NOW, THEREFORE BE IT RESOLVED, that the City of Brooklyn Center supports the above referenced project and authorizes the submittal of a proposal for funding of this project on behalf of the City of Brooklyn Center to the LCCMR in response to the 2026 ENRTF Request for Proposal; and BE IT FURTHER RESOLVED, that, if funding is awarded, the City of Brooklyn Center agrees to accept the award and may enter into an agreement with the state of Minnesota for the above referenced project. The City of Brooklyn Center will comply with all applicable laws, environmental requirements, and regulations and any additional conditions stated in the grant agreement and the approved LCCMR work plan; and BE IT FURTHER RESOLVED, that the City of Brooklyn Center understands that grants from the ENRTF are generally paid out on a reimbursement basis. The City of Brooklyn Center has the financial capability to pay for project expenses prior to seeking reimbursement; and BE IT FURTHER RESOLVED, that the City of Brooklyn Center certifies none of the current principals of the City of Brooklyn Center have been convicted of a felony financial crime in the last ten years. For this propose, a principal is defined as a public official, a board member, or staff that would have the authority to access or determine the use of ENRTF funds, if awarded; and BE IT FURTHER RESOLVED, that the City Manager is authorized to submit on RESOLUTION NO. 2025-034 behalf of the City an application for the Minnesota's Environment and Natural Resources Trust Fund grant for land acquisition of nine parcels located at 1000, 1020, 1050, 1100, and 1150 Shingle Creek Crossing for the purpose of day -lighting shingle creek.
