CHARTER COMMISSION MEETING
The continued meeting of May 22 was called to order by Chairman Stan Leino at 7:00 PM. This
meeting was originally scheduled to be held on June 12, but was rescheduled to July 10 when it was
determined that a quorum could not be attained on June 12.
Roll Call: Secretary Gary Brown called roll; Gary Brown, Stan Leino, Harold Middleton, Ed Nelson,
Eileen Oslund, Richard Phillips, Bruce Lund, and Mary Nierengarten were present.
Absent: Gail Ebert
Old Business
Administrative Fines and Penalties Motion by Nelson seconded by Lund to direct the City Council to
place on the November 2008 general election ballot (in accordance with State Statute 410.12) a question
to the voters to amend the charter by adding section 12.13 Fines and Penalties as follows:
Subdivision 1. The Council may shall establish by ordinance a procedure for
imposing an administrative penalty for any violation of the City Code or a City
ordinance. The procedure shall provide that any party charged with an administrative
penalty will receive notice of a violation and an opportunity to be heard by a neutral
party. The procedure shall authorize the City to use the services of a third party
hearing officer to decide whether an administrative penalty should be imposed.
Passed unanimously (8 -0).
Motion by Phillips, seconded by Middleton to adjourn the meeting at 7:35 PM.
