HomeMy WebLinkAbout2008 05-22 CHCMMINUTES OF May 22, 2008 BROOKLYN CENTER CHARTER COMMISSION MEETING The meeting of May 22, 2008, was called to order by Chairman Stan Leino at 7:07 PM. Roll Call: Secretary Gary Brown called roll; Gary Brown, Stan Leino, Harold Middleton, Ed Nelson, Eileen Oslund, Richard Phillips, and Gail Ebert were present. Excused Absent: Mary Nierengarten Absent: Bruce Lund Also Present: Council Member Dan Ryan Consideration of Minutes of January 23 and January 30 Motion by Nelson, second by Phillips to approve the minutes of both January 23 and January 30 as submitted. Passed unanimously 7 -0. New Business Motion by Oslund and seconded by Middleton to authorize Chairman Leino to purchase a gift of appreciation from Charter Commision budget for Richard Theis, who has recently moved to Champlin and has served on the Charter Commission for many years, passed unanimously 7 -0. Old Business Administrative Fines Chairman Leino updated the Commission regarding the joint meeting with the City Council on May 19, 2008, and as to the current status of the City Council vote, which was not unanimous to approve an amendment to Section 12.13. This results in a decision to be made by the Charter Commission as to whether to or not to place a question on the ballot to amend the Charter in a special election or the upcoming general election or not to take any action. Since the commission lacked the needed 8 members present to vote on a charter amendment, Brown made a motion, seconded by Nelson to table action by the Charter Commission until 6:00 PM June 12, passed unanimously 7 -0. Motion was made by Brown seconded by Phillips to suggest to the City Council that they review possible language of a question that may be placed on the ballot in the upcoming general election and that such language might possibly include the first two sentences of Section 12.13 Fines and Penalties, previously approved by the Charter Commission as follows; "Should the charter be amended to allow the Council to establish by ordinance a procedure for imposing administrative penalty for any violation of the City Code or a city ordinance. The procedure shall provide that any party charged with an administrative penalty will receive notice of violation and an opportunity to be heard by a neutral third party." Passed unanimously (7 -0). Motion by Nelson, seconded by Middleton to suspend the meeting at 8:21 PM until 6:00 PM, June 12, 2008. Passed unanimously (7 -0), Submitted for consideration, Gary E.
