CITY HALL CALL TO ORDER The meeting was called to order by Chairperson Mary Heitzig at 7:04 P.M. ROLL CALL Members present: David Ault, Ulyssess Boyd, Benjamin Chatelle, Ron Christensen, Edward Commers, Mary Heitzig, Everett Lindh, Barbara Sexton, and Dennis Snook Members absent and excused. Mona Hintzman, Tony Kuefler, Beverly Wolfe Members absent and unexcused: Al Anderson, Dennis Kueng, Neil Smeaton APPROVAL OF MINUTES Motion by Ed Commers, seconded by Ben Chatelle to approve the minutes of September 27, 1989, as presented. Motion passed unanimously. CORRESPONDENCE Chairperson Heitzig stated letters were written to Rita Seymour, Brooklyn Center Post Editor, regarding tonight's meeting as well as the one vacancy we will have on the commission as of December 1. Both items did appear in the Brooklyn Center Post, Chairperson Heitzig stated we have not had further communication with the City Manager regarding the new truth and taxation law, and she instructed the Administrative Assistant to send the City Manager a reminder an this subject. Chairperson Heitzig also instructed the Administrative Assistant to send a letter to Chief Judge Lindberg expressing the wishes of Everett Lindh to be reappointed to another four year term. His first four year term expires on January 14, 1990. OLD BUSINESS *Q pies r? Metre Citip. Charters As per the memo members received with their agendas and minutes for this meeting, the City Clerk is maintaining the two 3 ring binders holding these charters in her office. A sign out sheet is in the front of each binder along with a Charter Commission membership list so city staff knows who may check these charters out. The Administrative Assistant indicated that 2/3 of these charters have been copied, and she hopes to finish making a xerox copy of these charters before year end. *Review of Charter Sections Regm�Uz Vac kng nn the CoqnLJ_L, Chairperson Heitzig proceeded with discussion regarding the revision of the charter sections pertaining to council vacancies (Sections 2.03, 2.04a, 2.04b, 2.05, and 2.06). Members were to review these sections as well as the information provided by the Administrative Assistant from other metro city charters on these sections. Commissioner Ed Com mers suggested that he felt a combination of Brooklyn Park's and Brooklyn Center's wording could be a possibility. He provided members with a copy of this proposed wording for Section 2,05. Discussion that followed Commissioner's Commers' suggested wording prompted questions such as: who declares a council vacancy and when should the vacancy be published what if the term of office created by a vacancy is more than one year in length exactly how many days should the council be allowed to fill a vacancy what is the process or procedure for someone who wants to fill a vacancy the area on moral turpitude may be outdated where is there a charter section on removal from office? Notion was made by Ed Commers, seconded by Everett Lindh to delay this issue until our next meeting; at that time, the new Chairperson will appoint a subcommittee to study these issues. Motion passed unanimously. At this point, the Chairperson was questioned as to the status of the Mayor Nyquist's ethical behavior investigation regarding his personal business/ company. It was stated that this subject is being watched, and he is innocent until he is proven guilty. NEW BUSINESS *Appointment nf__1QMj_pati.ng Comittee for Officer Nomi nees for Annual Nee t i Chairperson Heitzig appointed Ben Chatelle, Ed Commers, Beverly Wolfe, and Barbara Sexton (Chair) as the Nominating Committee. This committee will provide names for the full commission's consideration for Chairperson, Vice-Chairperson, and Secretary for 1990. These names will be presented to the full commission at the Annual Meeting in January. *V_1�date on Vacancies _Qn_the Chart Commission Mary Heitzig's term expires December 1, and she cannot be reappointed as she has served eight years on the commission. Everett Lindh term expires January 14, 1990, and he wishes to be reappointed as stated earlier in these minutes, Neil Smeaton's term expires January 27, 1990, and he cannot be reappointed as he has served beyond his two full four year terms. -2- 11-29-89 0 Vacancies on the Charter Commission continued: Dennis Kueng's term expires March 4, 1990, and he cannot be reappointed as he has served eight years on the commission. Chairperson Heitzig encouraged members to be looking for people who are willing to serve on the commission, especially women who may be interested are encouraged to apply. NEXT MEETING DATE It was a consensus of the members present that the next Charter Commission meeting will be held on Wednesday, January 24, 1990, at 7 P.M. This will be our annual meeting, and there will be election of officers and appoint- ment of committee chairs for Audit, Public Relations, and Parliamentarian, ADJOURNMENT Motion was made by Ben Chatelle to adjourn at 8:02 P.M.
