HomeMy WebLinkAbout1983 10-26 CHCMBROOKLYN CENTER CHARTER COMMISSION MINUTES M October 26, 1983 CALL TO ORDER The Charter Commission was called to order by Chairman Beauchane at 8 :05 P.M. ROLL CALL Members present: Michael Beauchane, Donn Escher, William Hannay, John Lescault, Jean Schiebel, Barbara Sexton, Neil.Smeaton, Vincent Tubman, Mary Heitzig, and Dennis Kueng Members absent: Ernest Erickson (unexcused) APPROVAL OF MINUTES Motion by Donn Escher, seconded by William Hannay to approved the May 25, 1983, minutes as typed. Passed unanimously. PROGRESS OF CHARTER AMENDMENTS At the City Council meeting of September 12, 1983, the City Attorney questioned the changes related to Sections 5.09 and 8.04. The reader is referred to the minutes of September 12, 1983, of the City Council for further details. After further reviewal on why Section 5.09 was amended, it was found that the Charter Commission did want the wording changed from "one through three" to "one to three." Therefore, the proposed amendment on Section 5.09 will stand as presented to the City Council. Motion was made by Bill Hannay, seconded by Dennis Kueng that the proposed amendment on Section 8.04 be left just as stated to the City Council. This motion was withdrawn. Motion was made by Donn Escher, seconded by Dennis Kueng, that the Chairman contact the city attorney and obtain from him by November 30 his written interpretation regarding Section 8.04 (particularity to the meaning of "Public Works "Haw Performed "for the protection of the City and "all persons furnishing labor and materials prior to considering seeking outside counsel. Discussion followed; then a motion was made by Bill Hannay, seconded by Neil Smeaton to move the foregoing motion. Passed unanimously. Motion passed unanimously. DISCUSSION ON SECTION 9.03 EMINENT DOMAIN Motion by Donn Escher, seconded by Bill Hannay that regarding Section 9.03, it should be amended to read: "The City shall,within seventy (70 days after the filing of the commissioner's report, or in case of an ap- peal within forty -five (45) days after the final judgments or stipula- tions of settlement thereon, pay any award of damages allowed pursuant to this section and State law whether the commissioners or upon appeal." Motion passed unanimously. C ITY BUDGETING PROCESS Chairman Beauchane passed out Proposed Charter Section 7.06 October 26, 1983. This item the City Manager. a draft copy of the City Manager's Passage of the Annual Budget dated was tabled pending hearing comments from PUBLICATION OF ORDINANCES Motion by Bill Hannay, seconded by Neil Smeaton, that the Charter Commission has no further action regarding Resolution 81 -57. Motion passed unanimously. 0 OTHER OLD BUSINESS Regarding an ethics policy, the Charter commission was informed that there is no statute for ethics for elected officials. It was further discussed that the City Manager should respond to Chairman Beauchane's letter-of December 2, 1982, regarding an ethics policy. There was some discussion on the city's odd -year elections. It was the consensus of the Charter Commission to leave our election pro- cedures as is. Barb Sexton will contact Mona Hintzman regarding becoming a Charter Commission member. Chairman Beauchane has received no comments from Mr. Adkinson who was sent a letter regarding becoming a member also. It was suggested that Ernest Erickson, Publicity Chairman, contact Mary Jane at the Brooklyn Center Post for some news coverage on our openings.
