APPROVAL OF MINUTLS
Motion by Jean Schiebel, seconded by Barbara Sexton to approve the
April 27, 1.983,.,minutes as typed. Passed unanimously.

fi ned as a Commission member as he is movinL
the Commission membership is at eleven members.
Commissioner Erickson indicated that Charles Adkinson was contacted
after Kaleidoscope, and he would like to receive an application form.
Commissioner .Erickson also indicated that past commissioners were also
contacted, and that Mona Hintzman is willin, to reapply. Chairman
Beauchane stated he would be in contact with these two people.
REVIEW OF REC O ?I`1ENDF.D CHARTER AMENDMENTS
Before discussing:; the May 18, 19_F3 memo__from Tom Bublitz to Gerald
G. Splinter, City Mana�r,er and other recommended charter amendments,
it was stated that Minnesota Statutes Chapter 10A did not apply to
ethics for city officials.
Motion by Bill Hannay, seconded by Barbara Sexton to leave Section
3.03 as is presently stated in the Charter. Passed unanimously.
4 by Bill Hannay, seconded by .Barbara Sexton, that the third
sentence of Sec. 8.03 should be chan�_,ed to read; "Such ordinances shall be
amended only by an affirmative vote of at_lt:ast four fifths (4 of the
members of the Council." Passed unanimously by 8 commissioners.
Motion by Bill Hannay, seconded by Neil Smeaton, that the second
sentence of Section 8.04 should be changrI'ed to read: "The City may
require contractors to ,five bonds for the protection of the City and
all persons furnishing; labor and materials pursuant to the laws of
the State." Passed unanimously by 8 commissioners.
It was the consensus of the group to find out further from the City
Attorney whether the 70 days be chant -ed in both places mentioned or
just the last one regarding Section 9.03.
REVIEW.' OF RECOMMENDED CHARTER AMENDA2ENTS CON' T
Motion by Dennis Kueng, seconded by Bill Hannay to completely omit
Section 12.12 Disposition of Fines and Penalties and renumber sub-
sequent sections accordingly. Passed unanimously by 8 commissioners.
Motion by Bill Hannay, seconded by Donn Escher to leave Section 2.03
as is presently stated in the Charter. Passed unanimously.
Motion by Jean Schiebel, seconded by Neil Smeaton, that the fifth
sentence of Section 2.0; should be changed to read: "If the Council
fails to fill a vacancy within thirty (30) days, the city clerk shall
call a special election to fill the vacancy." Passed unanimously by
8 commissioners.
Motion by Ernest Erickson, seconded by Barbara Sexton, that the first
sentence of Section 3.02 should be changed to read: "The City Clerk
or the City Clerk's designee shall act as Secretary of the Council."
Passed unanimously by 8 commissioners.
Motion by Bill Hannay, seconded by Donn Escher to leave Section 3.07
as is presently stated in the Charter. Passed unanimously.
Motion by Ernest Erickson, seconded by Barbara Sexton, that the first
sentence is Subdivision 5 of Section 6.02 should be changed to read:
"The City Manager shall attend all meetings of the Council, unless
excused by the Mayor, with the right to take part..." Passed unani-
mously by 8 commissioners.
Motion by Neil Smeaton, seconded by Jean Schiebel, that the fourth
sentence of Section 6.04 (beginning, with "The Clerk may be... be
deleted from this section. Passed unanimously by 8 commissioners.
Motion by Bill Hannay, seconded by Barbara Sexton, that the first
sentence of Section 7.09 should be changed to read; "The Council may
include a contingency appropriation as a part of the budget but not
to exceed five percent (5 of the total appropriation of the general
fund -made in the budget for that year." Passed unanimously by 8 com-
missioners.
Motion by Neil Smeaton, seconded by Barbara Sexton to completely omit
Section 7.16 Bonds Outside the Debt Limit. Passed unanimously by
8 commissioners.
Motion by Donn Escher, seconded by Barbara Sexton that whenever an
entire section is deleted from the Charter that the Table of Contents
be modified accordingly. Passed unanimously.
Motion by Donn Escher, seconded by Bill Hannay, that the last sentence
of Section 11.01 should be chanted to read: "The operation of all public
utilities owned by the City shall be under the supervision of the City
Mianav -er and that the first sentence of Section 11.02 should be changed
to read: "Upon recommendations made by the City Mana�zer or upon its own
motion..." Passed unanimously by 8 commissioners.
j o Motion by Donn Escher, seconded by Neil Smeaton, that Chairman Beauchane
forward to the City Council a transmittal of charter changes approved
by the Charter Commission at its May 2 1983, meeting. Passed unanimously.
This transmittal will also include changes to Sections 2.01, 2.05, 2.06,
and 15.09 which were passed June 23, 1982.

SUI',ZMARY OF REMAININ:a BUSINESS
Chairman Beauchane will check further into Section 9.03 and will also
46 contact the two prospective commission members.
The Charter Commission will be receiving information from the City
Manager retarding the followin:, items: oaths, ethics, passage of
annual budget, and comments regardin�, Sections 10.01 and 10.04 of
the Charter.
NEXT MEETING DATE
The next Charter Commission meetinC will be on October 26 at 8:00 P.M.
