RESOLUTION NO. 2025-54
RESOLUTION AUTHORIZING THE REINSTATEMENT FEE FOR
BAYMONT INN & SUITES, AND AUTHORIZING THE CITY OF
BROOKLYN CENTER TO APPROVE AND ISSUE THE HOSPITALITY
ACCOMMODATIONS LICENSE
WHEREAS, pursuant to Chapter 23, Section 23-2400 of the Brooklyn Center City
Code, Hospitality License Holders have until May 1 of each year to apply for and
renew their Hospitality Licenses; and
WHEREAS, on March 9, 2025, Baymont Inn & Suites (Baymont), located at 2050
Freeway Blvd in Brooklyn Center, MN 5 543 0, submitted an incomplete application
for the renewal of the Hospitality Accommodations License; and
WHERAS, on May 9, 2025, Baymont attempted to pay their outstanding
application fee; and
WHEREAS, as of May 12, 2025, the City Council considered the matter and
determined that the application was incomplete with multiple violations, including
failure to renew the license, unpaid lodging tax penalties, previously unpaid utility
charges, outstanding code violations, and safety violations; and
WHEREAS, on May 12, 2025, the Brooklyn Center City Council suspended the
hospitality license for 60 days subject to the following conditions: Comply with
City Code Section 23-2414 paragraphs A-E; Comply with all requirements related
to the License Type, which is License Level I; Secure and show proof of all
applicable County and State licenses, permits, compliance reports, etc.; Undergo a
full City Code Inspection (zoning code, fire code, building code, etc.) prior to
license reinstatement; Pay all outstanding fees, penalties, and fines including the
Lodging Tax Penalties of $518.08 and the Outstanding City Utilities of $9,554.42;
Pay restitution to the City for the emergent relocation of lodgers from Baymont Inn
and Suites on March 26-March 28, 2025 in the amount of approximately $1,814.44;
Submit to periodic inspections of the premises to ensure continued compliance with
city laws and regulations due to ongoing fire safety issues, and the need to
immediately relocate individuals from the Baymont due to safety issues and
subsequent lack of response to emergency; Fix and secure ingress and egress doors
for occupant safety; Maintain onsite management presence for all shifts; Provide
regular updates to the City Manager regarding the status and compliance with these
conditions; Occupants may not be evicted during the time of suspension; Licensee
may not rent to any new guests;
WHEREAS, as of May 27, 2025, certain conditions outlined have been fulfilled;
and

WHEREAS, a reinstatement fee of $300, which is one and a half of the annual
renewal fees, is recommended to be paid prior to the license issuance;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center, Minnesota, that the City Council authorizes the City Manager to
reinstate the Hospitality License for Baymont upon satisfaction of all conditions as
outlined in the Licensing Order issued on May 13, 2025, and as restated in this
resolution, and payment of the fee of $300.

The motion for the adoption of the foregoing resolution was duly seconded by member
Jerzak
and upon vote being taken thereon, the following voted in favor thereof:
Graves, Jerzak, Kragness, Moore
and the following voted against the same: none
whereupon said resolution was declared duly passed and adopted.
