HomeMy WebLinkAbout1983-048 CCR1 Member Gene Lhotka introduced the following resolution and moved its adoption: RESOLUTION NO. 83 -48 RESOLUTION DENYING THE APPEAL OF HOWE, INC. WHEREAS, Howe, Inc. has proposed the acquisition of excess M/DOT right- of-way legally described in Planning Commission File No. 83001 and hereinafter referred to as "Parcel A" for the purpose of combining Parcel A with Howe, Inc. Addition; and WHEREAS, the Director of Planning and Inspection of the City of Brooklyn Center has ruled that the acquisition of Parcel A by Howe, Inc., the integration of Parcel A with Howe, Inc. Addition, and the use of Parcel A for the production of fertilizer would be an unlawful expansion of a nonconforming use, to -wit: The production of ammoniated fertilizer; and WHEREAS, Howe, Inc. has appealed that decision of the Director of Planning and Inspection and the matter is before the City Council sitting as the Board of Appeals: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that the appeal of Howe, Inc. is hereby denied and the decision of Director of Planning and Inspection in its interpretation of the Brooklyn Center Zoning Ordinance is hereby upheld. March ATTEST: 14, 1983 Da r i i The motion for �h6 adoption of the foregoing resolution was duly seconded by member Rich Theis and upon vote being taken thereon, the following voted in favor thereof; Dean Nyquist, Gene Lhotka, Celia Scott, Bill Hawes, and Rich Theis; and the following voted against the same; none, whereupon said resolution was duly passed and adopted.
