HomeMy WebLinkAbout1983-119 CCRMember Bill Hawes introduced the following resolution and moved its adoption: RESOLUTION NO. 83 -119 RESOLUTION REVIEWING ADDITIONAL INFORMATION REGARDING APPLICATION NO. 83021, THE APPLICATION OF DIANE WRIGHT FOR A SPECIAL USE PERMIT TO OPERATE A BOARD AND CARE FACILITY FOR MENTALLY ILL ADULTS WHEREAS, the District Court has requested the City Council to review amendments to the parking plan and the remodeling (occupancy) plan previously submitted as well as the detrimental effect of the facility on the standards set forth in Section 35 -220 of the City Zoning Ordinance that would not exist if the property were occupied by usual type tenants; and WHEREAS, the City Council agreed to hear information from the applicant and a report from Dr. Hector C. Zeller on the issues raised: NOW, THEREFORE, based upon the information received the Council finds: 1. The space needs of 18 mentally ill persons are greater than the space needs of four "usual type" families. 2. The facility contains adequate space for no more than 12 mentally ill persons together with support staff. 3. The addition of two extra parking spaces does not provide appreciably more parking space for visitors, residents of the facility, and service vehicles and such off street parking is necessary to maintain the parking and traffic standards of Brooklyn Center. 4. The addition of two extra parking spaces reduces the outdoor living space, which is already inadequate for 18 mentally ill persons. 5. Mentally ill persons need and do establish exclusive living space and overcrowding results in stress which provokes irregular behavior which inhibits the socialization needed for integration into the mainstream of society. 6. Housing 18 residents, together with five staff members, would jeopardize the goals of the facility and compromise the welfare of the residents. 7. The Council heard testimony from Ms. Marge Whirley, Mr. Jerry Schneider, and Ms. June Thirese who gave information that the space provided is adequate for the program, that Dr. Zeller was misinformed about the prospective residents of the facility and that the program meets the standards of the State of Minnesota but the Council gives greater weight to the opinion of Dr. Zeller. RESOLUTION NO. 83 -119 C 1 8. The Council is convinced that the establishment of the group home will not promote or enhance the general welfare and will be detrimental to the public health, safety and comfort of the residents of the group home. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL of the City of Brooklyn Center, Minnesota, that the applicant has not met the standards of Section 35 -220 of the zoning ordinance.
