adoption:
RESOLUTION NO. 83 -35
RESOLUTION OPPOSING LEGISLATIVE REDISTRICTING AMENDMENTS PROPOSED
BY HOUSE FILE NO. 116
WHEREAS, a Federal Census was conducted for the year 1980 which
indicated, among other things, the population distribution within the City
of Brooklyn Center; and
WHEREAS, on the basis of the 1980 census, the Federal District Court
reapportioned Minnesota legislative districts; and
WHEREAS, the Federal District Court, on March 11, 1982, developed a
reapportionment plan placing the entire City of Brooklyn Center within Senate
District 47 and portions of the City in House Districts 47A and 47B; and
WHEREAS, the City Council has considered the factors of population
distribution within Brooklyn Center, new legislative district lines, community,
neighborhood and various school district boundaries within the City, and has
amended its voting precinct boundaries accordingly; and
WHEREAS, requests to the Federal District Court by municipalities to
amend its redistricting plan were not considered, since in the opinion of the
Court, an adoption of the requests for amendments would breach the Court's
criterion for population equality, absent additional modifications in surrounding
areas; and
WHEREAS, House File No. 116 proposes to alter the redistricting plan
developed by the U.S. District Court and adopted and implemented by all Minnesota
municipalities; and
WHEREAS, the amendments contained in House File No. 116 are not based
on criterion for population equality; and
WHEREAS, the amendments proposed in House File No. 116 would require
the City of Brooklyn Center to create a new voting precinct for an inordinately
small number of eligible voters at additional cost to City residents; and
WHEREAS, the City has a similar situation in that portion.orf the City
lying in House District 47A and which has created additional cost and voter
confusion:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center as follows:
1. The Brooklyn Center City Council opposes passage of House File
No. 116 on the grounds that the redistricting amendments contained
in the bill are not based on accepted criterion for population
equality.

2. The new voting precinct which would be necessitated by House
File No. 116 would mean additional cost to the City, create
voter confusion and would not be in the best interest of the
City of Brooklyn Center.

The motion for the adoption of the foregoing resolution was duly seconded by
member Gene Lhotka and upon vote being taken thereon, the following
voted in favor thereof: Dean Nyquist, Gene Lhotka, Celia Scott, Bill Hawes,
and Rich Theis;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
