HomeMy WebLinkAbout1979 11-28 CHCMMinutes of the Proceedings of the Brooklyn Center Charter Commission November 28, 1979, 8 p.m. City Hall Present: Commissioners Michael Beauchane, Jack Boldischar, Jerry Campion, Robert DeVries, Ernest Erickson, Donn Escher, Bill Hannay, Raymond Maik, Orlander Nelson, Jean Schiebel, Mary Simmons, Edwin Theisen, Vincent Tubman, and Ann Wallerstedt were present. Absent: Commissioner Cheryl Asplund was absent because of another meeting. Introductions: New commissioners Jean Schiebel, Mary Simmons, and Jack Boldischar were introduced. Rules of Procedure: The rule requiring 10 to pass amendment to the city council. or to put on the ballot was discussed. Nine commissioners chose to have the rule changed to 2/3 vote of the actual membership with never less than 8 votes needed for passage. The rule needs to be rewritten. Amendments 3 and 24: Motion by Commissioner Escher, seconded by Commissioner Beauchane that Section 2.04, Subd 1 be amended as follows: INCOMPATIBLE OFFICES. No member of the Council shall be appointed City Manager, nor shall any member hold any paid municipal office or employment for the City, nor shall any member contract to supply goods or services to the City; and until one (1) year after the expiration of the member's term as Mayor or Council member, no former member shall be appointed to any paid appointive office or employment for the City,nor enter into any contract to provide goods or services to the City. The motion passed unanimously. Amendment 25: Motion by Commissioner Escher, seconded by Commissioner Campion that Section 2.04, Subd. 2 be written as follows: PRIVATE EMPLOYMENT. No former Mayor or Councilmember may, within one year after leaving the position, appear or participate in proceedings before the Council representing the interests of private persons, firms or corporations. All commissioners voted for the amendment except Commissioner Beauchane who was opposed. Section 6.02 subd. 5: Motion by Commissioner DeVries, seconded by Commissioner Nelson that it not be changed. Motion carried unanimously. Amendment 24: Motion by Commissioner Escher, seconded by Commissioner Erickson that Amendment 24 be adopted as corrected November 28, 1979. Motion passed unanimously. Amendment 2: Section 2.03 on limiting council terms: Stanley Peskar states that limiting terms is a violation of the state constitution, Article 7, Section 6. Motion by Commissioner Theisen that changes to 2.03 be tabled at this time. Second by Commissioner Erickson. Commissioner Tubman suggested that the commission get an attorney general's opinion on this. The motion passed unanimously. a Brooklyn Center Charter Commission November 28, 1979 page two Amendment 4: Section 2.05 changing quorum of council from 3 to 4: Motion by Commissioner Theisen, seconded by Commissioner Wallerstedt that this amendment be dropped. A quorum of 4 could be very restrictive. Motion carried unanimously. Extend meeting time: Motion by Commissioner Schiebel, seconded by Commissioner Beauchane that the meeting be extended for 15 minutes. Motion carried. Amendment 11: Three nominees instead of 2 on the ballot: Motion by Commissioner Maik, seconded by Commissioner Wallerstedt that the amendment be dropped. No demand from the public for this and it could help a splinter candidate.. Commissioner Escher moved the question;:, seconded by Commissioner DeVries. All commissioners voted for the motion except Commissioner Tubman who was opposed. Amendment 13: that the charter be construed liberally in favor of the people: Motion by Commissioner Maik, seconded by Commissioner Wallerstedt that the amendment be dropped. Motion carried unanimously. Amendment 15: City shall not expend city money or services in opposition to or in favor of a petition: Motion by Commissioner Maik, seconded by Commissioner Wallerstedt that the amendment be-dzoppeda.' 'r Commissioners voting for the motion: Beauchane, DeVries, Escher, Maik, Simmons, Theisen and Wallerstedt. Commissioners voting against the motion: Boldichar, Campion, Erickson, Nelson, Schiebel, and Tubman. Motion carried. Resignation: Commissioner Theisen announced that he would be resigning as of January 1, 1980. Next meeting: The next meeting will be Wednesday, January 9, 8 p.m. at City Hall. Adjournment: Motion by Commissioner Maik, seconded by Commissioner DeVries that the meeting be adjourned. Motion carried.
