HomeMy WebLinkAbout1979 01-24 CHCMMinutes of the Proceedings of the BROOKLYN CENTER CHARTER COMMISSION 0 Wednesday, January 24, 1979 Call to order: Acting Chairman James Gillen called to the meeting to order at 8:05.p.m. Present: Commissioners Cheryl Asplund, Jerry Campion, Robert DeVries, Michael Beauchane, Donn Escher, James Gillen, William Hannay, Mona Hintzman, Frank Kampmeyer, Orlander Nelson, Barbara Swart, Vincent Tubman, Edwin Theisen, and Ann Wallerstedt were present. Absent: Commissioner Betty Johnson was absent. New Commissioners: Acting Chairman Gillen introduced new commissioners Donn Escher and Michael Beauchane. Minutes: motion by Commissioner Hannay, seconded by Commissioner Hintzman that the minutes of November 29, 1978 be approved. Motion carried. Annual Report: Acting Chairman Gillen read his annual report. Motion by Commissioner Hintzman, seconded by Commissioner DeVries that the report be approved and be sent to the Chief Judge. Motion carried. Memorandum from City Manager Splinter: Acting Chairman Gillen reviewed Memorandum of Janualry 17, 1979 from City Manager Splinter to Council Members and Charter Commission Members. Motion carried unanimously. Audit Chairman Report: Audit Chairman Hintzman reported expenses of $11.28 for charter certificates $141.30 for secretarial services for a total of $152.58. A balance of $1,347.42 was unexpended for year 1978. Motion by Commissioner Theisen, seconded by Commissioner Kampmeyer to approve the report. Motion carried. Amendment 3a: Sec. 2.04: Motion by Commissioner Nelson, seconded by Commissioner Asplund to the change the charter as follows: No member of the Council shall be appointed City Manager, nor shall any member hold any paid municipal office or employment for the City; and until- eee- yeareftee- ire- expir�ctierc -ef- his -te from the office of Mayor or Councilman, no former member shall be appointed to any full time paid appointive office or employment for the City �ahiei�- effiee- er- etnpiapmeat pass- e�ea�ed -er- the- emeit�rnente- a �a$3e?�- were -ir�er ea seerdarYng -his- term as Geeneilman until one year after expiration of his term or his resignation. Motion carried unanimously. Brooklyn Center Charter Commission January 24, 1979 page two Amendment Sa:'Sec. 3.01: The Mayor or any two members of the Council may call Is special meetings of the Council up at least twelve- heurls twenty -four hours' notice to each member of the Council. All meetings of the Council shall be pttblie in compliance with the Minnesota Open Meeting Law, and any records thereof shall be made available at all resonable times. Motion by Commissioner Asplund, seconded by Commissioner Nelson that the above Amendment 5a be approved. Motion carried. Amendment 9a: Sec. 3.08: Motion by Commissioner Asplund, seconded by Commissioner Tubman that the amendment read: Notification of passage including a summary and all amendments to the original published ordinance shall be published in the official newspaper 30 days after passage. Commissioner Escher moved the question. Motion carried. Amendment 17: The amendment remains the same as first passed. Amendment 19a:Sec. 6.05: Motion by Commissioner Theisen, seconded by Commissioner Fgnb pr to arrani- the wnrdina ac n_ rnnngPd hV City MAnPSPr Snl inter as PURCHASE AND CONTRACTS. The City Council. shall by resolution, establish and maintain a purchasing policy for the City of Brooklyn Center. All contracts, bonds, and instruments of any kind to which the City is a party shall be signed by the Mayor and the City Manager on behalf of the City and shall be executed in the name of the City. Motion carried. Amendment 20a: Sec. 6.06: Motion by Commissioner Hintzman,seconded by Commissioner Campion to accept the wording as proposed by City Manager Splinter as CONTRACTS: HOW LET. Every contract for the purchase of supplies, materials equipment or the .rental thereof, or the construction, alteration, repair or maintenance of real or personal property shall be in accordance with the Uniform Municipal Contracting Law, M.S.A. Section 471.345. Subject to the provisions of this charter, the Council may by resolution adopt further regulations for the making of bids and the letting of contracts. Motion carried. Amendment 21: Sec. 7.16. Motion by Commissioner Hintzman, seconded by Commissioner Theisen to delete Sec. 7.16. Motion carried. Brooklyn Center Charter Commission January 24, 1979 page three Coffee Break: 9:20 p.m. to 9:27 p.m. Rules of Procedure Committee: Committee was directed'to came back to the Charter Commission with proposed wording. Nominating Committee Report: The Nominating Committee nominated the following: Chairman: Robert DeVries William Hannay Vice Chairman: Ann Wallerstedt Jerry Campion Secretary: Barbara Swart Motion by Commissioner Escher, seconded by Commissioner Campion that the nominations for chairman be closed. Motion carried. Commissioner Hannay was elected Chairman. Motion by Commissioner Nelson, seconded by Commissioner Hintzman that the nominations be closed for vice chairman. Motion carried.. 'Commissioner Wallerstedt was elected vice chairman. Motion by Commissioner Nelson, seconded by Commissioner Hannay that an u nanimous al a s✓- ,c cast for Barbara Swart f- GC.crctaly. Motio;i carried. The following were appointed: Audit Chairman: Donn Escher Public Relations Chairman: Jerry Campion. Certificates of Service: Certificates were given to James Gillen, Mona Hintzman, and Frank Kampmeyer for 8 years of service on the Charter Commission. Next meeting: The nest meeting of the. Charter Commission will be Wedn€bsday., March 7. Adjourment: Motion by Commissioner Hintzman,seconded by Commissioner Gillen that the weeting be adjourned. Motion carried.
