Wednesday, February 22, 1978
Inter of interested applicants: No one applied for the vacancy. There-
fore the secretarial assistant wi..11. check with applicants of last
July to inquire if they still have an interest in the Charter
Commission.
Call to order: Chairman Vi Kanatz called the meeting to order.
Present: Commissioners Bill Hannay, Mora Hintzman, Vi Kanatz, Cheryl. Asplund,
Ann Wallerstedt, Ed Theisen, Rich Higgins, Orlander Nelson, .Tames
Gillen, Vince Tubman were present, Commissioner.; Betty Johnson,
Barbara Swart, Bob DeVries, and Frank Kampmeyer'were absent.
Minutes of January 25: Commissioner IIi_ggl.ns complimented the secretarial
assistant on the minutes. Motion by Commissioner Nelson,
seconded by Commissioner Higgins that the minutes be approved.
Motion carried.
4th review of Chapter 5: Commissioner Hintzman reported. on Chapter 5.
Section 5.01: Motion by Commissioner Hintzman, seconded by Commissioner
Hannay that language be drafted which will accoir_pl.sh the
proposal that the charter shall b-- construed liberally in
favor of the people, with a possible change in section 1.02.
Commissioners in favor of the motion: Hannay, Nelson, Tubman,
Hintzman, and Kanatz. Commissioners opposed to the motion:
Higgins, Asplund, Gillen and Wallerstedt. Motion carried.
Section 5.02: Motion by Commissioner Hintzman, seconded by Coimi?issioner
Higgins that the statement on financial disclosure be deleted.
Commissioners in favor of motion: Hannay, Hintzman, Nelson,
Gillen, Higgins and Tubman. Cor. against the motion:
Theisen, Wallerstedt, and Asplund. Motion. carried.
Motion by Commissidr.er Hintzman, seconded by Commnissioner Hannay
that language be drafted that no city money be exper,dc in f voL
of or in opposition to file net:iLior_. Motion. carried unanimously.
Those drafting sen. fence should include money and services,
Motion by Commissioner Higgins seconded by Coannissioner Gillen
that no city money be expended prior to any violation of a
misdemeanor. Commissioner Theisen stated that the misappropriation
of city funds is a misdemeanor already. Commissioners in favor
of the motion: Higgins. Commissioners opposed to the motion:
Hannay, Hintzman, Asplund, VIallerstedt, Theisen, Nelson, Gillen
and Tubman. Motion lost.

section 5.03, 5.04 and 5.05 Committe2 reacomended no changer, No co
recommended changes.
Section 5.06: Motion by CoirrmiGsLoaer 'RIrtzmna, scconded by Commissioner Hannay
that language be draRad "without c .al lening its constitutionality
or any other legal aspect." The challonge should be after the
legisinion is passed. Cnvmtysioner Theisen stated that the Charter
Commission cannot legally do this. Motion by Commissioner Hannay,
seconded hy Commissioney ThOsen thst this motion be tabled Motion
passed unanimously, Chairman Kanatz will check on this.
Secticn 3.07 and 5.08: NO Lhoages were "Aw
Section 5.09: Motion by Counissioner Hintzman, so by COMMissioner Thaisen
410.12 sub 7 be substituted for 410.31 sub 1, 24 3, and 4. Motion
carried unanimously with Commissioner Gillen not voting.
Sec ticn 5.10, 5.11 and 5.12: No changes were suggested,
N we eti n g: Next meeting of the Charter. Commission will be Wednesday, March 22,
1978 at 8 p D. hen Chapters 6, 7, and 8 will be reviewed.
New Business: Nbtion by Commissioner Gillen, seconded by Commissioner Wallerstedt
that a new list of charter commissioners delete age, sex, and race.

Prospective There is still time to apply, call directly to the
Chief judge Euguenn Minenko by Friday, March 10.
Adjournment; Motion- by Corti niss ion (-,r Nelson, suconded by Commissioner Higgins that
the meeting be adjourned; Motion carried unanimously.
