HomeMy WebLinkAbout1976 04-07 CHCMMinutes of the Proceedings of the BROOKLYN CENTER CHARTER COMMISSION Wednesday, April 7, 1976 Call to order: The meeting was called to order by Chairman Henry Dorff, at 7:35 p.m. Present: Commissioners Cheryl Asplund, Glen Bullick, Robert DeVries, Henry Dorff, Richard Higgins, Mona Hintzman, Mildred Hendrickx, Betty Johnson, Viola Kanatz, Frank Kampmeyer, Barbara Swart, and. Edwin Theisen were present. Counsel Steve Oman was also present. Absent: Commissioners James Gillen (conflict) and Walter Vennewitz (conflict) were absent. Minutes: Motion by Commissioner Swart, seconded by Commissioner DeVries that the minutes of 'March 31, 1976 be approved. Motion carried. Letter from Chairman Dorff: Chairman Dorff read his letter in answer to a letter written by Commissioner Swart mailed to all commissioners and also printed in the Brooklyn Center Post. Charter Amendment Petition Signatures* In reply to request made by attorney Gary Market that the original signatures be given to him, counsel recommended that the Charter Commission retain the original signatures. He could receive copies at his own expense. Charter Amendment Petition: !'Motion by Commissioner Kanatz, seconded by Commissioner Nelson that the Charter Commission move the amendment petition on without action. The motion was ruled out of order by� seh: "I'he motion to re- consider must be made by a commissioner who voted against the original motion or by permission of the chairman. Proposed charter amendment was read by Secretary Barbara Swart. Sponsors of amendment: The sponsors, William Hannay, George Heenan, Vincent Tubman, Marlene Forstrom and James Vaughn were introduced to the commissioners. George Heenan made the presentation to the Charter Commission, and answered commissioners questions. Suspend rules: Motion by Commissioner Swart to suspend the rules of procedure to adjourn at 10 p.m. Rules were checked and no such rule exists. Charter Amendment Petition: Motion by Commissioner Kanatz, seconded by Commissioner Nelson that in accordance with section 410.12, subdivision 1 of state statutes that the Charter Commission pass the proposed amendment on to the City Council at its next meeting without recommendation. Chairman Dorff did not give permission for the motion. Commissioner Hintzman called the question to limit debate which takes a 2/3 vote. Commissioners voting yes were Hintzman, Swart, Nelson, Kanatz, I s Bullick and Hendrickx. Commissioners voting no were Higgins, Johnson, Asplund, DeVries, Theisen, Kampmeyer and Dorff. Debate continued. April 7, 1976 page 2 Charter Amendment Petition: Bill Arrell, first chairman of Charter Commission spoke on history of the charter. Phyllis Papke, H.J.M. Fourre, and Marlene Forstrom spoke. Dick Forstrom had a question for counsel. Motion by Commissioner Kanatz, seconded by Commissioner Nelson that the Charter Commission submit charter amendment to the City Council at their next meeting. Commissioners Hintzman, Swart, Nelson, Kanatz, Bullick and Hendrickx voted yes, Commissioners Higgins, Johnson, Theisen, Kampmeyer, Dorff, Asplund and DeVries voted no. Motion defeated. Motion by Commissioner Theisen, seconded by Commissioner Higgins that the Charter Commission establish two meetings the week of April 19th and proper public notice be given to hear both sides. Commissioners Theisen, Kampmeyer, Higgins, DeVries, and Dorff voted yes, Hendrickx, Belson, Kanatz, Swart, and Hintzman voted no with Bullick abstaining. Motion defeated. Motion by Commissioner Theisen, seconded by Commissioner Higgins, that the Charter Commission establish a deliberative meeting on Wednesday, April 21 to decide this issue. Commissioner Theisen withdrew motion and Commissioner Higgins withdrew second. Adjournment: 'Motion by Commissioner Theisen, seconded by Commissioner Higgins that the meeting be adjourned. motion carried. The meeting adjourned at 11:05 P.M.
