NOTICE OF PUBLIC HEARING ON PROPOSED AMENDMENT
TO BROOKLYN CENTER CITY CHARTER
NOTICE IS HEREBY GIVEN that the City Council of the City of Brooklyn Center,
Minnesota will conduct a public hearing on

at P.M., or as soon thereafter as the matter can be heard, in the Council Chambers in
City Hall, 6301 Shingle Creek Parkway, in the City, to consider oral and written testimony
concerning a proposed amendment to Chapter 12 of the Home Rule Charter of the City. In general
terms, the proposed amendment provides that the manner of amending ordinances will be
accomplished by underscoring new matter and striking out old matter.
Auxiliary aids for persons with disabilities are available upon request at least 96 hours in advance.

The Charter Commission recommends that the amendment be adopted by ordinance of the
City Council in the manner prescribed by Minnesota Statutes, Section 410.12, Subdivision 7. Under
that procedure, designed to facilitate routine charter amendments, the City Council must, if the
Council approves the amendment, adopt the amendment by ordinance after the public hearing by a
unanimous vote of all of its members. The adopting ordinance is effective 90 days after its passage
and publication, but if within 60 days thereof a petition signed by a number of registered voters
equal to two percent of the votes cast in the City at the last state general election, or 2,000 registered
voters, whichever is less, is filed with the City Clerk, the ordinance is not effective until approved
by 51 of votes cast on the amendment at the regular municipal election or a special election called
for that purpose.
The proposed amendment would amend Chapter 12 of the Charter by adding:
Section 12.13 to read:
Section 12.13. Fines and Penalties.
Subdivision 1. The Council may establish by ordinance a procedure for
imposing an administrative penalty for any violation of the Citv Code or a City ordinance.
The procedure must provide that any person chareed with an administrative penalty will
receive notice of a violation and an opportunity to be heard by a neutral party. which may be
the city council. The procedure may authorize the City to use the services of a non -City
emplovee to decide whether an administrative penalty should be imposed.
Subdivision 2. The Citv Council may provide by ordinance that unpaid
administrative penalties be collected as a special assessment aiaainst property which was the
subiect matter, or related to the subiect matter, of the penalty or against the propertv which
was the location of an activity, nroposed use, delivery of City service, or other
circumstances that resulted in the penalty. The ordinance must provide that the City will
first attempt to obtain voluntary pavment of the nenalty. The ordinance must also provide

that notice and an opportunity to be heard will be given to the nro owner listed on the
official tax records before the penalty is assessed.
Anyone wishing to express an opinion about the proposed amendment orally or in writing
will be heard at the public hearing.
