moved its adoption:
RESOLUTION NO. 79 -24
RESOLUTION ACCEPTING BID FOR FRONT END LOADER
WHEREAS, the Director of Public Works and City Clerk have
reported that on December 28, 1978, at 11 :00 o'clock A.M., central
standard time, they opened and tabulated bids received for a front
end loader, and that said bids were as follows:

WHEREAS, the bid of Midway.Tractor Equipment does not comply
with the specifications; and
WHEREAS, the bid of Ziegler, Inc., complies with the specific-
ations and includes a 5 year maintenance bid and a guaranteed repurchase
price; and
WHEREAS, the Director of Public Works has shown that the bid of
Ziegler, Inc., represents the best bid submitted to the City of Brooklyn
Center.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center that the bid of Ziegler, Inc., for a Caterpillar 930
rubber -tired front end loader with a 5 year maintenance contract and
guaranteed repurchase provision in the amounts of $49,795.00 for the
machine, including repurchase provisions, and $760.00 per year additional
for the 5 year maintenance contract, all in accordance with specifica-
tions, is deemed to be the best bid submitted by a responsible bidder,
and said bid is hereby accepted.

The motion for the adoption of the foregoing resolution was duly
seconded by member Bill Fignar and upon vote being taken
thereon, the following voted in favor thereof: Dean Nyquist, Tony
Kuefler, Bill Fignar, Gene Lhotka and Celia Scott;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
