RESOLUTION NO. 78 -149
RESOLUTION AMENDING THE SCHEDULE OF RATES, FEES AND
CHARGES FOR THE USE OF AND CONNECTION TO THE SANITARY
SEWER SYSTEM OF THE CITY OF BROOKLYN CENTER
WHEREAS, a municipal public utilities department exists for the
purpose of providing and maintaining water and sanitary sewer facilities
for the citizens of the City of Brooklyn Center; and
WHEREAS, it is the requirement of the City Charter that the Public
Utilities Department be a self sustaining entity through revenue provided
by a uniform schedule of rates, fees, and charges; and
WHEREAS, the Metropolitan Waste Control Commission, formerly
known as the Metropolitan Sewer Board, assumed ownership and operation
of all existing interceptors and treatment works needed to implement the
Metropolitan Council's Comprehensive Plan for collection, treatment, and
disposal of sewage in the Metropolitan area pursuant to the Metropolitan
Sewer Act, Chapter 449, 1969 Session Laws, State of Minnesota; and
WHEREAS, the Metropolitan Waste Control Commission, in order to
receive and retain grants in compliance with the Federal Water Pollution
Control Acts of 1972 and regulations thereunder, adopted Resoluticn No.
76 -172, on June 15, 1976, imposing an Industrial User Sewer Strength
Charge upon users of the Metropolitan Disposal System to recover operation
and maintenance costs of treatment works attributable to the strength
of the discharge of industrial waste, such sewer strength charge being in
addition to the charge based upon the volume of discharge and
WHEREAS, Minnesota Statutes, Section 444.075, Subd. 3, empowers
the City to make such sewer charge to be charged against the owner,
lessee, occupant or all of them, and certify unpaid charges to the
County Auditor as a tax lien against the property served; and
WHEREAS, consistent with Chapter 11 of the Brooklyn Center City
Charter, the City Council on August 14, 1978, conducted a public hearing
at which opportunity was afforded all interested citizens to be heard.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center that the schedule of sanitary sewer rates, fees, and
charges be adopted in amended form as follows:

Persons meeting the above requirements shall file with the City
in January of each year an affidavit approved by the City.

The number of unit equivalents which are connected or for which a building
permit is issued shall be computed in accordance with the guidelines
set forth by the Metropolitan Waste Control Commission on file in the
office of the City Engineer. A summary of the guidelines is as follows:

BE IT FURTHER RESOLVED as follows:
1. That the Strength Charge established above shall be paid
by each industrial user receiving waste treatment services
and subject thereto before the twentieth (20th) day next
succeeding of date of billing thereof to such user by and
on behalf of the City, and such payment thereof shall be
deemed to be delinquent if not so paid to the billing
entity before such date, and if such payment is not paid
before such date an industrial user shall pay'interest
compounded monthly at the rate of two- thirds of one percent
(2f3 per month on the unpaid balance due.
2. As provided by Minnesota Statutes, Section 444.075, Subd. 3,
it is hereby approved, adopted, and established that if
the payment of the Strength Charge established above is not
paid before the sixtieth (60th) day next succeeding the
date of billing thereof to the industrial user by or on
behalf of the City, said delinquent sewer Strength Charge,
plus accrued interest established pursuant to the above
shall be deemed to be a charge against the owner, lessee,
and occupant of the property served, and the City or its
agent shall certify such unpaid delinquent balance to the
County Auditor with taxes against the property served for
collection as other taxes are collected provided however
that such certification shall not preclude the City or
its agent from recovering of such delinquent sewer Strength
Charge and interest thereon under any other available remedy.
3. The above amended schedule of sanitary sewer rates, fees,
and charges becomes effective for accounts billed after
August 14, 1978.

The motion for the adoption of the foregoing resolution was duly seconded
by member Bill Fignar and upon vote being taken thereon, the
following voted in favor thereof: Dean Nyquist, Tony Kuefler, Bill Fignar,
Gene Lhotka, and Celia Scott;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
