HomeMy WebLinkAbout1978-157 CCR Member Tony Kuefler introduced the following resolution and moved its adoption: RESOLUTION NO. 78 -157 RESOLUTION REGARDING CITY OWNED PROPERTY ON THE SOUTH SIDE OF I -94 LYING WESTERLY OF SHINGLE CREEK PARKWAY WHEREAS, the City of Brooklyn Center has requested Mn /DOT to construct the crossing of Shingle Creek Parkway over I -94 at an early date in order to facilitate the development of the Brooklyn Center Industrial Park;and WHEREAS, Mn /DOT is planning to let a contract for the construction of the bridge approaches for the overpass of Shingle Creek Parkway at I -94 in December 1978; and WHEREAS, Mn /DOT is presently acquiring the right -of -way necessary to perform said construction; and WHEREAS, one area of the said right -of -way to be acquired is the land colored in red shown on the attached exhibit "A" which belongs to the City of Brooklyn Center; and WHEREAS, Mn /DOT has requested clarification of the City's intended usage of the land in the said area colored red at the time that the City property was acquired; and WHEREAS, the City has a "Proposed Comprehensive Plan 1985" which was drawn in September, 1963, and adopted on November 7, 1966 which indicated the intended usage of the said land; and WHEREAS, the said Comprehensive Plan shows Shingle Creek Parkway crossing I -94; and WHEREAS, said roadway was dedicated to the public in the platting of the Twin Cities Interchange Park and approved by the City Council on August 2, 1967; and WHEREAS, the said Comprehensive Plan proposed the property lying westerly of Shingle Creek Parkway and southerly of I -94 to be used for future park lands and a freeway off ramp; and WHEREAS, on December 27, 1978, the City of Brooklyn Center purchased said property from the Brooklyn Center Industrial Park for the purposes of multiple use easterly of Shingle Creek and a park westerly of Shingle Creek; and Resolution No. 78 -157 WHEREAS, the land on the west side of Shingle Creek Parkway colored red on the attached exhibit was planned for joint development as highway /park lands in advance of acquisition of said property for multiple use purposes; and WHEREAS, the City of Brooklyn Center constructed the southerly bridge approach along Shingle Creek Parkway in 1969 with portions of the fill slope for said approach lying within said multiple use property; and WHEREAS, the land colored in green on exhibit "B" (which is reprinted from the Proposed Comprehensive Plan 1985) encompasses the area colored in red on exhibit "A NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center as follows: 1) That the land that the Minnesota Department of Transportation is planning to acquire from the City of Brooklyn Center as colored red on exhibit "A was planned for joint development as a highway in advance of acquisition of property for multiple use purposes. 2) That the City owned property in the area between Shingle Creek and Shingle Creek Parkway lying southerly of I -94 was acquired for multiple usepurposes. 3) It is intended that this resolution clarify the City of Brooklyn Center's intended use of said property. July 24, 1978 Date Mayo ATTEST: Clerk The motion for the adoption of the foregoing resolution was duly seconded by member Gene Lhotka and upon vote being taken thereon, the following voted in favor thereof: Dean Nyquist, Tony Kuefler, Bill Fignar, Gene Lhotka, and Celia Scott; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
