moved its adoption:
RESOLUTION NO. 78 -164
RESOLUTION REGARDING RECOMMENDED DISPOSITION OF
APPLICATION NO. 78032 SUBMITTED BY MR. R. L. TOHNSON
WHEREAS, Application No. 78032 submitted by Mr. R. L. Johnson proposes
rezoning, from R3 (Townhouse and Garden Apartments) to C2 (Commerce) of the
property located in the 7200 block on the west side of Brooklyn Boulevard; and
WHEREAS, the Commission held a duly called public hearing on June,15,
1978 when testimony both for and against the request was taken; and
WHEREAS, the item was referred to the Northwest Neighborhood Advisory
Group which discussed the matter on June 29, 1978, and which, in a letter
dated July 5, 1978, recommended that the property be rezoned to a split zoning,
C1 (Service /Office Commercial) for the southerly portion of the site, and C2
for the northerly portion of the site, for the reasons stated therein; and
WHEREAS, the Commission on July 27, 1978 considered the matter; and
WHEREAS, the Commission reviewed the request in terms of the Comprehensive
Plan criteria for the area, and in terms of the Rezoning Criteria contained in
Section 35 -208 of the City Ordinances:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center that Application No. 78032 submitted by R. L. Johnson be
denied in consideration of the following:
1 The request does not meet the Rezoning Evaluation Guidelines
contained in Section 35 -208 of the City Ordinances and is
characteristic of "spot zoning," i.e., zoning which discriminates
in favor of a particular landowner and is not consistent with
the Comprehensive Plan or with accepted planning principles.
2. Testimony was offered by neighboring residential property owners
who had been notified of the public hearing and who expressed
the desire to retain the present zoning, or a zoning less intense
than C2, rather than establishing C2 uses in the area.
3. The proposal is not consistent with the Comprehensive Plan which
speaks to the desirability of establishing Service /Office Commercial
uses and Multiple Family Residential uses along Brooklyn Boulevard.
4. Rezoning the property cannot be contingent upon a particular
development proposal and would comprehend all the permitted and
special uses in the C2 zone, some of which the Commission
considers incompatible with the surrounding area.

The motion for the adoption of the foregoing resolution was duly seconded by
member Tony Kuefler and upon vote being taken thereon, the
following voted in favor thereof: Dean Nyquist, Tony Kuefler, Bill Fignar,
Gene Lhotka, and Celia Scott;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
