and moved its adoption:
RESOLUTION NO. 78 -35
RESOLUTION APPROVING PLANNING COMMISSION APPLICATION
NO. 78007 INCLUDING JOINT PARKING AGREEMENT BETWEEN
BROOKDALE WEST OFFICE BUILDING AND CROSS OF GLORY
LUTHERAN CHURCH
WHEREAS, Planning Commission Application No. 78007 comprehends
a joint parking agreement between the ownership of the Brookdale West Office
Building, 5901 Brooklyn Boulevard, and the Cross of Glory Lutheran Church,
5940 Ewing Avenue North submitted in accordance with the provisions of
Section 35 -720 of the City Ordinances; and
WHEREAS, said Agreement is necessary to create additional parking
for said office building in order to accommodate proposed medical uses beyond
those allowed through an earlier agreement approved under Council Resolution
No. 74 -46; and
WHEREAS, the site plan indicating the proposed joint parking and
related site improvements was endorsed by the Planning Advisory Commission
on February 9, 1978;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center that Planning Commission Application No. 78007 and the
Joint Parking Agreement between the Brookdale West Office Building and the
Cross of Glory Lutheran Church are hereby approved, subject to the following:
1 The Agreement shall be subject to review and approval by
the City Attorney as to content and form, and it shall be
filed as an easement encumbrance upon the title to the
Church property, as provided for in Section 35 -720 of
the City Ordinances.
2. Use of the additional parking shall be authorized upon
completion of the site improvements indicated on approved
plans, and a Performance Agreement and supporting financial
guarantee (in an amount to be determined by the City Manager)
shall be submitted to assure completion of the site work.
3. The extent to which facilities in said office building are
permitted for medical or dental uses shall be limited to
the amount of additional parking which is available through
the provisions of the approved joint parking agreement.
4. The City Council's approval of this agreement may be
terminated should the property taxes assigned to the church
property covered by this agreement either become delinquent
or, through appeal or other legal process, become tax exempt.

5. The concrete delineator in the joint parking area shall be
landscaped utilizing wood chip mulch and juniper plantings,
and additional delineation and signery shall be provided as
approved by the City Engineer.

The motion for the adoption of the foregoing resolution was duly seconded by
member Gene Lhotka and upon vote being taken thereon, the
following voted in favor thereof: Dean Nyquist, Tony Kuefler,
Gene Lhotka, and Celia Scott;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
