and moved its adoption:
RESOLUTION NO. 77 -212
RESOLUTION ORDERING CONSTRUCTION OF SANITARY SEWER
IMPROVEMENT PROJECT NO. 1977 -21
WHEREAS, the City Council received a petition from all of the
affected property owners requesting the construction of Sanitary Sewer
Improvement Project No. 1977 -21; and
WHEREAS, Chapter 429.031, Subdivision 3, Laws of Minnesota,
provides that: "Whenever all owners of real property abutting upon any
street named as the location of any improvement shall petition the
Council to construct the improvement and to assess the entire cost
against their property, the Council may, without a public hearing,
adopt a resolution determining such fact and ordering the improvement."
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center, that it has been determined that a petition signed
by all owners of real property to be benefited by the installation of
said sanitary sewer on Lakeside Avenue North from the centerline of
Twin Lake Avenue easterly approximately 170 feet has been received.
BE IT FURTHER RESOLVED that in accordance with Chapter 429.031,
Subdivision 3, Laws of Minnesota, the above described sanitary sewer
improvement be herewith ordered and authorized.
The estimated cost is $5,950.00.

The motion for the adoption of the foregoing resolution was duly
seconded by member Gene Lhotka and upon vote being taken
thereon, the following voted in favor thereof: Philip Cohen, Maurice Britts
Tony Kuefler, Bill Fignar, and Gene Lhotka;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
