moved its adoption:
RESOLUTION NO. 77 -153
RESOLUTION REGARDING DEVELOPMENT AND PLATTING OF PROPERTY
AT 6810 BROOKLYN BOULEVARD
WHEREAS, Planning Commission Application No. 76067 submitted on behalf of
Car -X Service Systems, Inc. was approved by the City Council on December 20, 1976,
comprehending a commercial development on property described as Tract A, Registered
Land Survey No. 456 and Tract A, Registered Land Survey No. 457, also known as 6810
Brooklyn Boulevard; and
WHEREAS, Planning Commission Application No. 77020 submitted on behalf of
Car -X Service Systems, Inc. (owner) and of Winchell's Donut House (tenant) was
approved by the City Council on June 6, 1977, comprehending a second commercial
development on the above property; and
WHEREAS, consistent with Section 35 -540 of the City Ordinances and conditions
of each of the above approvals, Planning Commission Application No. 77025 submitted
on behalf of Car -X Service Systems, Inc. was approved by the City Council on July 25,
1977 comprehending the combination of the above Tracts into a single Tract by means
of a new Registered Land Survey; and
WHEREAS, Car -X Service Systems, Inc. submitted a letter dated July 1, 1977
to the City as follows:
Pursuant to previous discussion on the subject property, this letter
is to confirm that Car -X Service Systems, Inc. owner of the property
known as 6810 Brooklyn Boulevard hereby acknowledges the City Zoning
Ordinance requirement that the property be combined through platting
or registered land survey into a single parcel under common ownership
for purposes of serving the commercial development approved by the
City Council under the Planning Commission Application No. 76067 and
No. 77020. This is to further acknowledge that Car -X Service Systems,
Inc. its heirs, successors, and assigns does covenant and agree 'that
'the property is 'to remain a single parcel under a common ownership
as long as the property serves 'the commercial development approved
and constructed under the above applications.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn
Center that the subject property known as 6810 Brooklyn Boulevard is to remain a single
parcel as approved under Application No. 77025, under a common ownership as long as
'the property serves a commercial development such as that approved under Applications
No. 76167 and No. 77020; and
RESOLUTION NO. 77 -153
BE IT FURTHER RESOLVED, that a certified copy of this resolution shall be
filed with the title to the subject property.

The motion for the adoption of the foregoing resolution was duly seconded by
member Bill Fignar and upon vote being taken thereon, 'the
following voted in favor thereof: Philip Cohen, Maurice Britts, Tony Kuefler,
Bill Fignar, and Gene Lhotka;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
