adoption:
RESOLUTION NO. 77 -168
RESOLUTION APPOINTING GERALD G. SPLINTER AS CITY MANAGER
AND SETTING FORTH CONDITIONS OF EMPLOYMENT
WHEREAS, the City Charter, adopted by the voters of the City of Brooklyn
Center on November 8, 1966 created the position of City Manager; and
WHEREAS, Donald G. Poss resigned as City Manager of the City of Brooklyn
Center on July 23, 1977; and
WHEREAS, the City Council following an extensive management search effort
has reviewed and interviewed four candidates regarding their qualifications for the
position of City Manager; and
WHEREAS, the City Council finds Gerald G. Splinter well qualified for the
position of City Manager; and
WHEREAS, the position of City Manager is not covered by the provisions
of Chapter 17 of the City Ordinances; and
WHEREAS, the City Council wishes to make an explicit statement of
conditions pertaining to the employment of Gerald G. Splinter as City Manager; and
WHEREAS, Gerald G. Splinter has reviewed the provisions of this resolution
and is in agreement therewith:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center as follows:
1 Gerald G. Splinter is appointed City Manager effective October 17, 1977
and shall serve at the pleasure of the Council.
2. Mr. Splinter shall perform the duties and meet the obligations of the
position of City Manager as set forth in the City Charter and Chapter 6
of the City Ordinances.
3. Mr. Splinter's salary shall be $34,000 per annum and adjustment to
the City Manager's salary shall be reviewed annually in conjunction
with the establishment of salaries for City employees beginning
January 1, 1979.
4. The City Manager shall be granted vacation, sick leave, and holiday
benefits according to the schedule of benefits granted other permanent
employees of the City except one year's sick leave shall be advanced
the City Manager during his first year of employment should the need
arise.

5. The City Manager shall reside within the City of Brooklyn Center
within twelve months following his effective date of appointment.
6. The full premium cost for family coverage under the Brooklyn Center
Group Health Plan and the full premium cost for .$55,000 of term life
insurance under the Brooklyn Center Group Life Insurance Plan shall
be paid by the City on the City Manager's behalf.
7. The City will provide the moving expenses for household goods to
Brooklyn Center based upon receipted vouchers in accordance with
best quotation received.
8. The City Manager shall have 24 hour use of a City car for City
business.
9. In the event of resignation, notice thereof shall be submitted in
writing to the City Council at least 30 days prior to the effective
date.
10. In the event of dismissal by the City Council, the City Manager
shall be notified at least 30 days in advance of the effective date
of dismissal and shall be furnished a written statement of the
reasons therefor, and further, shall be granted a hearing thereon
if requested.
11. In the event of voluntary resignation or death, severance pay
based on unpaid accrued vacation leave shall be paid to the City
Manager or his survivors.
12. In the event of involuntary resignation or dismissal, severance
pay based on unpaid accrued vacation leave and three month's
salary shall be paid to the City Manager; however, in the event
the City Manager is terminated because of his conviction of any
illegal act involving personal gain to him, the City shall have
no obligation to pay the aggregate severance sum designated in
this paragraph.

The motion for the adoption of the foregoing resolution was duly seconded by
member Bill Fignar, and upon vote being taken thereon, the following voted in
favor thereof: Philip Cohen, Maurice Britts, Tony Kuefler, Bill Fignar, and
Gene Lhotka;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
