and moved its adoption:
RESOLUTION NO. 77 -104

RESOLUTION APPROVING PRELIMINARY PLANS FOR THE IMPROVEMENT
OF T. H. 94 FROM 53RD AVENUE NORTH TO CAMDEN COURT.
WHEREAS, the Commissioner of the Department of Transportation
has prepared preliminary plans for the improvement of a part of Trunk
Highway Number 392 renumbered as Trunk Highway No. 94 within the
corporate limits of the City of Brooklyn Center, from 53rd Avenue
North to Camden Court; and
WHEREAS, said preliminary plans are on file in the Office of
the Department of Transportation, Saint Paul, Minnesota, being marked,
labeled, and identified as Layout No. 11B S.P. 2781 -09 from 40th Avenue
North to 61st Avenue North; and
WHEREAS, copies of said preliminary plans are so marked,
labeled, and identified are also on file in the Office of the City
Clerk; and
WHEREAS, the City of Brooklyn Center is working with represent-
atives of the Minnesota Department of Transportation relative to
upgrading the west frontage road of T.H. 94 from 59th Avenue North to
195 feet north of 61st Avenue North centerline; and
WHEREAS, said upgrading may allow a change in noise barrier
design to minimize the impact of said barriers to abutting residents;
and
WHEREAS, a survey of residents abutting the wall type noise
abatement barrier shows the majority of said residents prefer a wall
material of textured concrete block; and
WHEREAS, the term "said preliminary plans" as hereinafter used
in the body of this resolution shall be deemed and intended to mean,
refer to, and to incorporate the preliminary plans as in the foregoing
recitals particularly identified and described;.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center that said preliminary plans for the improvement of
T.H. 392 renumbered T.H. 94, within the limits of the City of Brooklyn
Center, be and hereby are approved with the following conditions:
1) That the noise barrier design between 58th Avenue North
and 61st Avenue North may be modified in coordination
with the City's plans for upgrading the west frontage
road of T.H. 94.
2) That the wall type noise abatement barriers be constructed
of a textured concrete block material.

The motion for the adoption of the foregoing resolution was duly
seaDnded by member Gene Lhotka and upon vote being taken
thereon, the following voted in favor thereof: Philip Cohen and Gene Lhotka
and the following voted against the same: Maurice Britts
whereupon said resolution was declared duly passed and adopted.
