HomeMy WebLinkAbout1976-171 CCR Member Tony Kuefler introduced the following resolution and moved its adoption: RESOLUTION NO. 76 -171 RESOLUTION APPROVING COLLECTIVE BARGAINING AGREEMENT BETWEEN TEAMSTERS PUBLIC AND LAW ENFORCEMENT EMPLOYEES UNION. LOCAL NO. 320 AND THE CITY OF BROOKLYN CENTER WHEREAS, the Public Employment Labor Relations Act of 1971 as amended thereafter requires a written contract between the employer and the exclusive representative of a recognized bargaining unit; and WHEREAS, Minnesota Teamsters Public and Law Enforcement Employees Union, Local No. 320 has been designated as the exclusive representative for the Brooklyn Center police bargaining unit; and WHEREAS, tentative agreement on 1976 -77 contract terms has been reached through collective bargaining between Minnesota Teamsters Public and Law Enforce- ment Employees Union, Local No. 320 and the Brooklyn Center City Manager representing the employer; and WHEREAS, advice has been received from the League of Minnesota Cities labor relations consultant that Section 9.5 of 'the 'tentative agreement is vague in its applicability to Brooklyn Center's long established career development /job enrichment /productivity program of assigning certain plain clothes duties on a rotating personnel basis: NOW, THEREFORE, BE IT RESOLVED by the Brooklyn Center City Council to approve and adopt by reference as though incorporated fully herein the document entitled: LABOR AGREEMENT BETWEEN THE CITY OF BROOKLYN CENTER AND MINNESOTA TEAMSTERS PUBLIC AND LAW ENFORCEMENT EMPLOYEES UNION, LOCAL NO. 320 dated December 6, 1976, three copies of which shall be on file and available for inspection in the office of the City Clerk. BE IT FURTHER RESOLVED that said approval and adoption is premised upon the understanding 'that Section 9.5 of the agreement is not to be construed 'to effectively prohibit the personnel rotation concept of the Assignee Program, which is operated pursuant to Minnesota Statutes Section 179.66, Subdivision 1 and Section 5.1 of the labor agreement. RESOLUTION NO. 76 -171 The Mayor and City Manager are hereby authorized 'to execute said agreement on behalf of the City of Brooklyn Center-.-- December 6, 1976 Date ,/mayor ATTEST:_ Clerk The motion for the adoption of the foregoing resolution was duly seconded by member Maurice Britts and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Maurice Britts, Tony Kuefler, and Bill Fignar; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
