and moved its adoption:
RESOLUTION NO. 76 -96
RESOLUTION REQUESTING THE MINNESOTA STATE HIGHWAY
DEPARTMENT TO CONSIDER ACQUISITION OF THE UNDEVELOPED
PROPERTY LYING SOUTHERLY OF F.I. 94 BETWEEN NOBLE
AVENUE NORTH AND TRUNK HIGHWAY 152 FOR NOISE ABATEMENT
WHEREAS, the Minnesota State Highway Departmet is currently
developing plans for noise abatement structures along F.I. 94, westerly
of T.H. 152 in the City of Brooklyn Center; and
WHEREAS, it is the desire of the City of Brooklyn Center that
earthen berms be utilized for said abatements wherever possible; and
WHEREAS, a strip of undeveloped land lies southerly of F.I. 94,
and easterly of Noble Avenue North; and
WHEREAS, said strip of land is a remnant of property acquired by
the Minnesota State Highway Department for the construction of F.I. 94; and
WHEREAS, the said strip of land lies within a residential zoned
and developed area of the City of Brooklyn Center; and
WHEREAS, the geometric configuration of said strip of land
discourages its development as a desirable single family residential
subdivision in accordance with the City Ordinances; and
WHEREAS, development of the said strip of land for higher density
residential properties has been deemed inconsistent with good planning
principles; and
WHEREAS, it is deemed by the City Council of the City of Brooklyn
Center that the best use for said strip of land is for construction of
earthen berms for noise abatement along F.I. 94.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center that the Minnesota State Highway Department consider
the acquisition of the strip of undeveloped land lying southerly of
F.I. 94 and easterly of Noble Avenue North for the purpose of constructing
earthen berms for noise abatement along F.I. 94.

The motion for the adoption of the foregoing resolution was duly
seconded by member Robert Jensen and upon vote being taken
thereon, the following voted in favor thereof: Philip Cohen,
Maurice Britts, Tony Kuefler, Bill Fignar, and Robert Jensen;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
