HomeMy WebLinkAbout1976-105 CCR Member Robert Jensen introduced the following resolution and moved its adoption: RESOLUTION NO.-76-105 RESOLUTION AMENDING RESOLUTION NO. 76 -56 AUTHORIZING PURCHASE OF 185 STORM WINDOWS FOR THE CIVIC CENTER WHEREAS, on April 5, 1976, the City Council adopted Resolution No. 76 -56 approving a contract for the purchase of 185 storm windows for the Civic Center in the amount of $2,493 from DeVac, Inc.; and WHEREAS, on July 7, 1976, the Controller of DeVac, Inc. informed the City Clerk that there had been a major mistake in the Company's quotation to the effect that the quoted unit price of $13.48 per window unit is less than the wholesale price of the product; and WHEREAS, DeVac, Inc. has consequently declined to execute the contract for $2,493, but instead has offered to furnish the windows at its cost amounting to $3,124.65; and WHEREAS, said amount of $3,124.65 is less than other quotations originally received; and WHEREAS, legal review indicates that it is questionable whether DeVac could be legally compelled to execute and perform the original contract proposal. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brooklyn Center, Minnesota finds that a mistake occurred in the quotation of DeVac, Inc. to furnish 185 storm windows for the amount of $2,493 and that to attempt to compel performance on such quotation would be unproductive. BE IT FURTHER RESOLVED that the City Manager be authorized to contract for the purchase of 185 storm windows in the amount of $3,124.65 from DeVac, Inc. August 9, 1976 Date Mayor ATTEST: Clerk The motion for the adoption of the foregoing resolution was duly seconded by member Maurice Britts and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Maurice Britts, Tony Kuefler, Bill Fignar, and Robert Jensen; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
